제안이유 및 주요내용
이 협약의 가입을 통하여 선박재활용 계획, 선박재활용시설 요건 및 유해물질에 대한 관리 등 선박재활용 활동에서 인간의 건강 및 환경에 미치는 부정적 영향을 방지하기 위한 국제 기준을 마련함으로써, 선박 안전과 인간의 건강 및 해양환경보호를 위한 국제사회의 노력에 동참하려는 것임.
주요내용
가. 선박의 유해물질 관리 및 재활용 준비 의무를 부과함(안 제4조 및 제5조, 부속서 제2장).
1) 선박에 유해물질의 설치나 사용을 금지·제한하고, 유해물질목록을 작성·비치하며 전 운항 수명 동안 유지·갱신하도록 규정함(안 부속서 제4규칙 및 제5규칙).
2) 선박이 검사 후 국제유해물질목록증서 및 국제재활용준비증서를 발급받도록 규정함(안 부속서 제10규칙부터 제14규칙까지).
3) 선박재활용 시 인증받은 선박재활용시설 등에서 재활용되고 선박재활용계획을 승인받도록 함(안 부속서 제8규칙 및 제9규칙).
나. 선박재활용시설의 인증, 선박재활용시설계획의 수립 및 유해물질의 처리 등에 관한 의무를 부과함(안 제4조 및 제6조, 부속서 제3장).
1) 선박재활용시설은 협약의 요건을 갖춰야 하며 문서 및 현장점검을 통한 검증 후에 인증을 받도록 함(안 부속서 제16규칙).
2) 선박재활용시설은 작업자의 안전과 인간의 건강 및 환경의 보호를 위한 선박재활용시설계획을 준비하고, 폭발, 화재 및 그 밖의 안전하지 않은 상태를 방지하는 절차를 수립·활용하도록 함(안 부속서 제18규칙 및 제19규칙).
3) 선박재활용 시 유해물질이 안전하고 환경친화적으로 제거되도록 하고, 비상 대비·대응 계획의 수립 및 작업자의 안전을 위한 훈련 프로그램 등을 제공하도록 함(안 부속서 제20규칙부터 제22규칙까지).
다. 선박재활용시설 인증정보 제공, 협약 준수 여부 결정을 위한 선박 점검, 선박과 선박재활용시설의 협약 위반에 대한 탐지, 국제기구 보고 등을 규정함(안 제7조부터 제12조까지).
1) 선박이 협약을 위반하고 있음이 탐지된 경우 점검을 수행한 당사자는 그 선박에 경고, 억류, 퇴거 또는 당사자의 항구로부터 퇴출 조치를 할 수 있음(안 제9조제3항).
2) 선박이 협약 요건을 위반한 경우 그 주관청의 법에 따라, 선박재활용시설이 협약 요건을 위반한 경우 해당 시설에 대하여 관할권을 갖는 당사자의 법에 따라 제재가 정해짐(안 제10조제1항).
가입 시 선언사항
대한민국 정부는 이 협약에 가입하면서 별지와 같이 선언함.

2009년 안전하고 환경친화적인 선박재활용을 위한 홍콩 국제협약 가입동의안
“2009년 안전하고 환경친화적인 선박재활용을 위한 홍콩 국제협약”에 정부가 가입하도록 「대한민국헌법」 제60조제1항에 따라 동의한다.

2009년 안전하고 환경친화적인 선박재활용을 위한 홍콩 국제협약
이 협약의 당사자는,
선박재활용 산업에서 안전, 건강, 환경 및 복지 문제에 대한 우려가 커지고 있음에 주목하고,
선박재활용이 지속가능한 발전에 기여하고, 그로써 운항 수명이 다한 선박을 위한 최선의 선택임을 인정하며,
국제해사기구 총회가 채택한 결의 A.962(23)(선박재활용에 관한 지침), 결의 A.980(24)에 의하여 채택된 지침의 개정, 선박의 전체와 일부 해체 시 환경친화적인 관리를 위한 기술 지침을 채택했던, 「유해 폐기물의 국가간 이동과 그 처리의 통제에 관한 바젤협약」 당사자들의 제6차 회의에서의 VI/24 결정, 그리고 국제노동기구 이사회의 제289차 회의에서 승인된 지침(선박 해체 시의 안전과 건강: 아시아 국가와 튀르키예를 위한 지침)을 상기하고,
국제해사기구 총회가 해당 기구의 해양환경보호위원회에 선박재활용에 관하여 법적 구속력이 있는 문서를 고안하도록 요구한 결의 A.981(24)을 또한 상기하며,
선박재활용에 관계되는 작업자의 직업상 안전과 건강을 보호함에 있어 국제노동기구의 역할에 대해서도 주목하고,
유해 폐기물에서 유발할 수 있는 부정적 영향으로부터 인간의 건강 및 환경을 보호하는 데 있어서 「유해 폐기물의 국가간 이동 및 그 처리의 통제에 관한 바젤협약」의 역할을 추가로 주목하며,
환경과 개발에 관한 리우 선언의 원칙 15에서 제시되고 1995년 9월 15일 국제해사기구의 해양환경보호위원회가 채택한 결의 MEPC.67(37)에서 언급한 예방적 접근법을 유념하고,
선박의 건조와 정비 시에 선박의 안전, 선원의 안전과 건강, 그리고 선박 운영의 효율성을 해하지 않으면서, 유해물질을 위험성이 적거나 가능한 한 비유해물질로 대체하는 것을 촉진할 필요성에 대하여 또한 유념하며,
법적 구속력을 갖는 문서로, 해상 운송의 특수성과 운항 수명을 다한 선박의 원활한 회수를 보장할 필요를 고려하여, 선박재활용과 관련된 환경적ㆍ직업적 건강 및 안전 위험을 효과적으로 다룰 것을 결의하고,
안전하고 환경친화적인 선박재활용을 위한 국제협약의 체결을 통하여 이러한 목적이 최고로 성취될 수 있을 것임을 고려하면서,
다음과 같이 합의하였다.
제1조
일반 의무
1.이 협약의 각 당사자는 선박재활용에 의하여 발생하는 인간의 건강 및 환경에 대한 사고, 상해 및 다른 부정적 영향들을 방지하고, 경감하며, 최소화하고, 가능한 범위 내에서 제거하기 위하여 이 규정들을 충실하고 완전하게 시행하며, 선박의 전 운항 수명 동안 선박 안전과 인간 건강 및 환경에 대한 보호를 증진시키도록 약속한다.
2.이 협약의 어떠한 규정도 인간의 건강 및 환경에 대한 부정적 영향을 방지하고, 경감하며, 최소화하기 위한 목적으로 안전하고 환경친화적인 선박재활용과 관련하여 당사자가 단독 또는 공동으로 국제법과 합치하는 더욱 강력한 조치를 하는 것을 막는 것으로 해석되지 않는다.
3.당사자는 이 협약의 효과적인 이행, 준수 및 집행을 목적으로 협력하도록 노력한다.
4.당사자는 안전하고 환경친화적인 선박재활용에 기여하는 기술 및 실행의 지속적인 발전을 장려하기로 약속한다.
5.이 협약의 부속서는 이 협약의 불가분의 일부를 구성한다. 달리 명시적으로 규정하지 않는 경우, 이 협약이라 함은 동시에 그 부속서도 해당한다.
제2조
정의
달리 명시적으로 규정되지 않는 경우, 이 협약의 목적상
1.“협약”이란 「2009년 안전하고 환경친화적인 선박의 재활용을 위한 홍콩 국제협약」을 말한다.
2.“주관청”이란 선박이 그 국기를 게양할 권리가 있거나, 그 권한하에 운항 중인 국가의 정부를 말한다.
3.“권한 있는 당국(들)”이란 특정 지리 구역(들) 또는 전문 분야(들) 내에서 협약에서 특정한 해당 당사자의 관할권 내에서 운영하고 있는 선박재활용시설과 관련된 의무를 담당하도록 당사자가 지정한 하나 또는 복수의 정부 당국을 말한다.
4.“기구”란 국제해사기구를 말한다.
5.“사무총장”이란 기구의 사무총장을 말한다.
6.“위원회”란 기구의 해양환경보호위원회를 말한다.
7.“선박”이란 해양환경에서 운항하고 있거나 운항하였던 모든 형태의 배를 말하며, 장비가 해체되었거나 예인되는 배를 포함하여 잠수선, 부유선, 부유플랫폼, 자기승강식 플랫폼, 부유식 저장설비 그리고 부유식 생산ㆍ저장ㆍ하역설비를 포함한다.
8.“총톤수”란 「1969년 선박톤수 측정에 관한 국제협약」 부속서 I 또는 모든 후속 협약에 포함된 톤수 측정 규칙에 따라 계산한 총톤수를 말한다.
9.“유해물질”이란 인간의 건강 및/또는 환경에 해를 초래할 수 있는 모든 물질 또는 성분을 말한다.
10.“선박재활용”이란 재처리 및 재사용을 목적으로 부품 및 재료를 회수하기 위하여 유해물질과 그 밖의 물질에 주의하면서 선박재활용시설에서 선박을 전체 또는 부분적으로 해체하는 활동을 말하며, 현장에서의 부품 및 재료의 보관 및 처리와 같은 관련 작업을 포함하나, 별도 시설에서의 추가적인 처리나 폐기는 포함하지 아니한다.
11.“선박재활용시설”이란 선박재활용에 이용되는 장소, 작업장 또는 시설로서, 한정된 구역을 말한다.
12.“재활용회사”란 선박재활용시설의 소유자, 또는 선박재활용시설의 소유자로부터 선박재활용 활동의 운영에 관한 책임을 부여받아 이 협약에 따라 부과되는 모든 의무와 책임을 인계 받기로 합의한 그 밖의 모든 기관이나 사람을 말한다.
제3조
적용
1.이 협약에 달리 명시적으로 규정되지 않는 경우, 이 협약은 다음에 적용된다.
가.당사자의 국기를 게양할 권리가 있거나 그 당사자의 권한하에서 운영되고 있는 선박
나.당사자의 관할권하에서 운영 중인 선박재활용시설
2.이 협약은 모든 군함, 해군보조함 또는 당사자가 소유하거나 운항하는 그 밖의 선박으로서 정부의 비상업적 업무로만 당분간 사용되고 있는 선박에는 적용하지 아니한다. 다만, 각 당사자는 그 당사자가 소유하거나 운영하는 그러한 선박의 운항 또는 운항 능력을 저해하지 않는 적절한 조치를 채택함으로써, 그러한 선박이, 합리적이고 실행가능한 한, 이 협약에 부합하는 방식으로 운항되도록 보장한다.
3.이 협약은 총톤수 500톤 미만의 선박 또는 선박이 게양할 권리가 있는 국기의 국가의 주권이나 관할권하에 있는 수역에서만 전 수명 동안 운항되는 선박에는 적용되지 아니한다. 다만, 각 당사자는 적절한 조치를 채택함으로써 그러한 선박이, 합리적이고 실행가능한 한, 이 협약에 부합하는 방식으로 운항되도록 보장한다.
4. 이 협약 비당사자의 국기를 게양할 권리가 있는 선박에 대하여, 당사자는 그러한 선박에 이보다 유리한 대우를 부여하지 않도록 보장하는 데 필요한 협약상 요건을 적용한다.
제4조
선박재활용에 관한 통제
1.각 당사자는 자국의 국기를 게양할 권리가 있거나 자국의 권한하에 운항 중인 선박이 이 협약에서 정한 요건을 준수하도록 요구하며, 그러한 준수를 보장하기 위하여 효과적인 조치를 한다.
2.각 당사자는 그 관할권하에 있는 선박재활용시설이 이 협약에서 정한 요건을 준수하도록 요구하며, 그러한 준수를 보장하기 위하여 효과적인 조치를 한다.
제5조
선박의 검사 및 증서 발행
각 당사자는 자국의 국기를 게양하거나 자국의 권한하에 운항 중이며 검사 및 증서 발행 대상인 선박이 부속서의 규칙에 따라 검사되고 증서를 발행받도록 보장한다.
제6조
선박재활용시설의 인증
각 당사자는 자신의 관할권하에 운영되고, 이 협약이 적용되는 선박 또는 이 협약 제3조제4항에 따라 유사하게 취급되는 선박을 재활용하는 선박재활용시설이 부속서의 규칙에 따라 인증받도록 보장한다.
제7조
정보 교환
어떤 당사자가 인증한 선박재활용시설에 대하여, 해당 당사자는, 요청을 받은 경우 인증에 대한 자신의 결정의 근거인 이 협약을 고려하여, 관련 정보를 기구와 그 요청을 한 당사자들에게 제공한다. 그 정보는 신속히 적시에 교환되어야 한다.
제8조
선박 점검
1. 이 협약이 적용되는 선박은 다른 당사자의 어떤 항구나 연안 터미널에서든, 그 선박이 이 협약을 준수하고 있는지를 결정하기 위하여 그 당사자가 정당하게 권한을 부여한 공무원의 점검 대상이 될 수 있다. 제2항에 규정된 경우를 제외하고, 그러한 모든 점검은 국제유해물질목록증서 또는 국제재활용준비증서가 선상에 있는지 검증하는 것으로 제한되며, 이러한 증서는 유효한 경우 수락된다.
2.선박이 유효한 증서를 가지고 있지 않거나, 다음과 같이 믿는 명백한 근거가 있는 경우,
가.선박 또는 선박 장비의 상태가 증서의 세부사항 및/또는 유해물질목록 제1부에 실질적으로 부합하지 않는 경우, 또는
나.유해물질목록 제1부의 관리를 위하여 선상에서 이행되는 절차가 없는 경우
기구가 고안한 지침을 고려하여 상세한 점검이 행해질 수 있다.
제9조
위반 탐지
1. 당사자는 위반 탐지와 이 협약 규정들의 집행을 위하여 협력한다.
2.선박이 이 협약의 규정을 위반하여 운항하고 있거나, 운항하였거나, 운항할 예정이라는 충분한 증거가 있는 경우, 그 증거를 보유한 당사자는 이 선박이 다른 당사자의 관할권하에 있는 항구나 연안 터미널에 입항할 때 그 선박의 검사를 요청할 수 있다. 해당 검사의 보고서는 적절한 조치가 취해질 수 있도록 검사를 요청한 당사자, 관련 선박의 주관청 및 기구에 송부된다.
3.선박이 이 협약을 위반하고 있음이 탐지된 경우, 점검을 수행한 당사자는 그 선박에 경고, 억류, 퇴거 또는 당사자의 항구로부터 퇴출 조치를 할 수 있다. 그러한 조치를 한 당사자는 관련 선박의 주관청과 기구에 이를 즉시 통지한다.
4.선박재활용시설이 이 협약의 규정을 위반하여 운영하고 있거나, 운영하였거나, 운영할 예정이라는 충분한 증거와 함께 어느 당사자로부터 조사 요청을 받은 경우, 당사자는 자신의 관할권하에 운영하고 있는 해당 선박재활용시설을 조사하고 보고서를 작성해야 할 것이다. 그러한 모든 조사 보고서는, 있는 경우, 취해진 또는 취해질 조치에 대한 정보를 포함하여 조사 보고서를 요청한 당사자에게 송부되며, 적절한 조치를 위하여 기구에 송부된다.
제10조
위반
1.이 협약의 요건에 대한 모든 위반은 국내법에 따라 금지되며,
가.선박의 경우 위반이 발생한 장소를 불문하고, 제재는 그 주관청의 법에 따라 정해진다. 주관청은, 어느 당사자로부터 어떠한 위반을 통지받은 경우, 그 사안을 조사하며, 위반혐의에 대한 추가적인 증거의 제공을 신고한 당사자에게 요청할 수 있다. 주관청은, 위반혐의에 관하여 소송절차에 회부할 수 있을 만큼 충분한 증거가 있다고 인정할 경우, 자국의 법에 따라 가능한 한 조속히 그러한 소송절차를 진행한다. 주관청은 취해진 모든 조치를 위반혐의를 신고한 당사자와 기구에 신속하게 통지한다. 주관청은, 정보를 접수한 후 1년 내에 어떠한 조치도 취하지 않은 경우, 조치를 하지 않은 이유를 위반혐의를 신고한 당사자와 기구에 신속하게 통지한다.
나.선박재활용시설의 경우, 제재는 해당 선박재활용시설에 대하여 관할권을 갖는 당사자의 법에 따라 정해진다. 당사자는, 다른 당사자로부터 그러한 위반을 통지받은 경우, 그 사안을 조사하며, 위반혐의에 대한 추가적인 증거의 제공을 신고한 당사자에게 요청할 수 있다. 당사자는, 위반혐의에 관하여 소송절차에 회부할 수 있을 만큼 충분한 증거가 있다고 인정할 경우, 자국의 법에 따라 가능한 한 조속히 그러한 소송절차를 진행한다. 당사자는 취해진 모든 조치를 위반혐의를 신고한 당사자와 기구에 신속하게 통지한다. 당사자는, 정보를 접수한 후 1년 내에 어떠한 조치도 취하지 않은 경우, 조치를 하지 않은 이유를 위반혐의를 신고한 당사자 및 기구에 통지한다.
2.어떠한 당사자의 관할권 내에서든 이 협약 요건의 어떠한 위반도 금지되며, 제재는 그 당사자의 법에 따라 정해진다. 그러한 위반이 발생한 때에는 언제든 그 당사자는
가.자국의 법에 따라 소송절차를 진행하거나,
나.당사자가 보유하고 있는 어떠한 위반이 발생했다는 정보와 증거를 선박의 주관청에 제공한다.
3.이 조에 따라 어느 당사자의 법에 따라 규정된 제재는 이 협약의 위반이 어디에서 발생되었든지 간에 그 위반을 억제하기에 적합한 강도여야 한다.
제11조
선박의 부당한 지연 또는 억류
1.이 협약의 제8조, 제9조 또는 제10조에 따라 선박이 부당하게 억류되거나 지연되는 것을 방지하도록 가능한 모든 노력이 이루어지도록 한다.
2.이 협약의 제8조, 제9조 또는 제10조에 따라 선박이 부당하게 억류되거나 지연되는 경우, 해당 선박은 발생된 손실이나 손해에 대한 보상을 받을 권리가 있다.
제12조
정보 전달
각 당사자는 다음의 정보를 기구에 보고하고, 기구는 적절하게 이를 유포한다.
가.이 협약에 따라 인증받고 그 당사자의 관할권하에 운영되고 있는 선박재활용시설의 목록
나.그 당사자의 단일 연락처를 포함한 권한 있는 당국(들)의 상세 연락사항
다.이 협약에 따른 선박재활용의 통제와 관련된 사안을 관리함에 있어서 그 당사자를 대행하도록 권한을 부여받은 인정된 기관 및 지명된 검사원의 목록, 그리고 인정된 기관 또는 지명된 검사원에게 위임한 권한의 구체적인 책임과 조건
라.국제재활용준비증서상 재활용회사의 이름 및 선박재활용시설의 위치를 포함하여, 그 증서가 발행된 해당 당사자의 국기를 게양하는 선박의 연간 목록
마.해당 당사자의 관할권 내에서 재활용된 선박의 연간 목록
바.이 협약의 위반에 관한 정보, 그리고
사.해당 당사자의 관할권하에서 선박과 선박재활용시설에 대해 취해진 조치
제13조
기술 지원 및 협력
1.당사자는 안전하고 환경친화적인 선박재활용과 관련하여 다음의 목적으로 기술 지원을 요청하는 당사자에 대한 지원을 직접적으로 또는 기구 및 그 밖의 국제단체를 통하여 적절하게 제공하도록 약속한다.
가.인력 훈련
나.관련 기술, 장비 및 시설의 가용성 보장
다.합동 연구 및 개발 프로그램 착수, 그리고
라.이 협약과 그와 관련하여 기구에서 고안한 지침의 효과적인 이행을 목표로 하는 그 밖의 조치 착수
2.안전하고 환경친화적인 선박재활용과 관련하여 당사자는 자신의 국내 법령과 정책에 따라 관리 시스템 및 기술 이전에 있어서 적극 협력하기로 약속한다.
제14조
분쟁 해결
당사자는 이 협약의 해석이나 적용에 관한 당사자 간 분쟁을 교섭이나 심사, 중개, 조정, 중재, 사법적 해결 또는 지역 기구나 조직으로의 회부를 포함한 당사자가 합의한 그 밖의 다른 평화적 수단을 통하여 해결한다.
제15조
국제법 및 다른 국제협약과의 관계
1.이 협약의 어떠한 규정도 1982년 해양법에 관한 국제연합협약과 국제해양관습법에 따른 모든 국가의 권리와 의무에 영향을 미치지 않는다.
2.이 협약의 어떠한 규정도 그 밖의 관련되고 적용가능한 국제협정에 따른 당사자의 권리와 의무에 영향을 미치지 않는다.
제16조
서명, 비준, 수락, 승인 및 가입
1.이 협약은 2009년 9월 1일부터 2010년 8월 31일까지 모든 국가에 대해 기구의 본부에서 서명을 위하여 개방되고, 그 후에는 모든 국가의 가입을 위하여 개방된다.
2.국가는 다음의 방법으로 이 협약의 당사자가 될 수 있다.
가.비준, 수락 또는 승인을 조건으로 하지 않는 서명, 또는
나.추후 비준, 수락 또는 승인을 하게 되는 비준, 수락 또는 승인을 조건으로 하는 서명, 또는
다.가입
3.비준, 수락, 승인 또는 가입은 사무총장에게 그러한 취지의 문서를 기탁함으로써 효력이 발생한다.
4.어떠한 국가가 이 협약에서 다루는 사안과 관련하여 적용가능한 법체제가 다른 둘 이상의 영역 단위로 구성된 경우, 그 국가는 서명, 비준, 수락, 승인 또는 가입 시 이 협약이 그 국가의 전 영역 단위에 적용되는지 또는 그 중 하나 이상의 영역 단위에만 적용되는지를 선언할 수 있으며, 언제든지 다른 선언을 제출함으로써 이 선언을 변경할 수 있다.
5.제4항에 따른 선언은 사무총장에게 서면으로 통보되고, 이 협약이 적용되는 영역 단위 또는 단위들을 명시적으로 기재한다.
6.어떠한 국가는 이 협약에 대한 자국의 기속적 동의를 표명할 때 자국의 인증된 선박재활용시설(들)에서 어떤 선박이 재활용되기 전 선박재활용계획에 대한 명시적 또는 암묵적 승인을 요구할지 여부를 선언한다. 이후 이 선언은 사무총장에게 통보함으로써 개정될 수 있다. 그러한 개정에는 개정의 발효일을 명시한다.
제17조
발효
1.이 협약은 다음의 조건들이 충족되는 날 후 24개월째 되는 날에 발효한다.
가.15개국 이상의 국가가 비준, 수락 또는 승인에 대한 유보 없이 서명하거나, 제16조에 따라 필요한 비준서, 수락서, 승인서 또는 가입서를 기탁한 경우
나.제1항가호에 언급된 국가들의 상선단의 합계가 전 세계 상선 총톤수의 40% 이상에 해당하는 경우, 그리고
다.지난 10년간 제1항가호에 언급된 국가들의 연간 선박재활용의 최대 용량의 합계가 동일 국가들의 전체 상선 총톤수의 3% 이상에 해당하는 경우
2.이 협약의 발효 요건이 충족된 후이지만 발효일 전에 이 협약과 관련하여 비준, 수락, 승인 또는 가입 문서를 기탁한 국가에 대해서, 비준서, 수락서, 승인서 또는 가입서는 협약의 발효일 또는 해당 문서를 기탁한 날 후 3개월째 되는 날 중 나중 일자에 효력이 발생한다.
3.이 협약이 발효한 날 후에 기탁된 모든 비준서, 수락서, 승인서 또는 가입서는 기탁일 후 3개월째 되는 날에 효력이 발생한다.
4.이 협약의 개정이 제18조에 따라 수락된 것으로 간주된 날 후에 기탁된 비준서, 수락서, 승인서 또는 가입서는 개정된 협약에 대하여 적용된다.
제18조
개정
1.이 협약은 다음 항에 명시된 절차 중 어느 하나를 통하여 개정될 수 있다.
2.기구 내 심의 후 개정
가.어느 당사자도 이 협약의 개정을 제안할 수 있다. 제안된 개정은 사무총장에게 제출되고, 그 후 사무총장은 기구 심의 최소 6개월 전에 이를 당사자와 기구의 모든 회원에게 회람한다.
나.위에 따라 제안되고 회람된 개정은 심의를 위하여 위원회에 회부된다. 기구 회원인지 여부를 불문하고 당사자는 개정의 심의와 채택을 위한 위원회 절차에 참가할 권리를 가진다.
다.개정은 투표 당시 3분의 1 이상의 당사자가 출석하는 조건으로, 위원회에 출석하여 투표하는 당사자 3분의 2 이상의 다수로 채택된다.
라.다호에 따라 채택된 개정은 수락을 위하여 사무총장에 의하여 당사자에게 전달된다.
마.개정은 다음의 상황에서 수락된 것으로 간주된다.
1)이 협약의 어떤 조에 대한 개정은 당사자 3분의 2가 사무총장에게 그에 대한 자신의 수락을 통보한 날에 수락된 것으로 간주된다.
2)협약 부속서에 대한 개정은 위원회가 그 개정을 채택하는 때에 결정하는 기간의 마지막 날에 수락된 것으로 간주하며, 그 기간은 채택일 후 10개월 이상이어야 한다. 다만, 해당 일자까지 3분의 1을 초과하는 당사자가 그 개정에 이의가 있음을 사무총장에게 통보하는 경우, 해당 개정은 수락되지 않은 것으로 간주된다.
바.개정은 다음의 조건하에 발효한다.
1)이 협약의 어떠한 조에 대한 개정은 그 개정을 수락한다고 선언한 당사자에 대하여 마호1)목에 따라 수락된 것으로 간주된 날 후 6개월째 되는 날에 발효한다.
2)부속서에 대한 개정은 다음과 같이 한 당사자를 제외하고, 개정이 수락된 것으로 간주된 날 후 6개월째 되는 날에 모든 당사자에 대하여 발효한다.
가) 당사자가 마호2)목에 따라 개정에 이의가 있음을 통보하였고 그러한 이의를 철회하지 않은 경우, 또는
나) 해당 개정안이 발효되기 전에, 당사자가 자신의 추후 수락 통보 후에만 해당 개정이 자신에 대하여 발효한다고 사무총장에게 통보한 경우
3)바호2)목가)에 따라 이의를 통보한 당사자는 그 개정을 수락한다고 사무총장에게 추후 통보할 수 있다. 그러한 개정은 그 수락 통보일 후 6개월째 되는 날 또는 그 개정이 발효하는 날 중 나중 일자에 발효한다.
4)바호2)목나)에 언급된 통보를 한 당사자가 사무총장에게 개정과 관련하여 수락한다고 통지하는 경우, 그러한 개정은 그 당사자에 대하여는 당사자의 수락 통보일 후 6개월째 되는 날 또는 개정의 발효일 중 나중 일자에 발효한다.
3.회의를 통한 개정
가.당사자 3분의 1 이상이 동의한 어떤 당사자의 요청이 있는 경우, 기구는 이 협약의 개정을 심의하기 위한 당사자 회의를 소집한다.
나.회의에 출석하여 투표하는 당사자 3분의 2 이상의 다수로 회의에서 채택된 개정은 수락을 위하여 사무총장이 모든 당사자에게 전달한다.
다.회의에서 달리 결정하지 않는 경우가 아니면, 개정은 제2항마호 및 바호에 각각 명시된 절차에 따라 수락되고 발효한 것으로 간주된다.
4.부속서에 대한 개정의 수락을 거부한 당사자는 그 개정의 적용에 관한 한 비당사자로 취급한다.
5. 이 조에 따른 모든 통보는 사무총장에게 서면으로 한다.
6.사무총장은 당사자와 기구 회원에게 다음에 대하여 통지한다.
가.발효되는 모든 개정과 그 개정의 일반적인 발효일 및 각 당사자에 대한 발효일, 그리고
나.이 조에 따라 이루어지는 모든 통보
제19조
폐기
1.이 협약은 어떤 당사자에 의해서든 그 당사자에 대하여 이 협약이 발효한 날부터 2년이 만료된 후에는 언제든지 폐기될 수 있다.
2.폐기는 사무총장에 대한 서면 통보로 이루어지며, 접수 후 1년 또는 그 통보에 명시된 그 이상의 기간에 효력이 발생한다.
제20조
기탁
1.이 협약은 사무총장에게 기탁되며, 사무총장은 이 협약의 인증등본을 이 협약에 서명하거나 가입한 모든 국가에 송부한다.
2.이 협약의 다른 부분에 명시된 기능에 추가하여, 사무총장은
가. 이 협약에 서명하거나 가입한 모든 국가에 다음을 통지한다.
1)각 신규 서명 또는 비준서, 수락서, 승인서 또는 가입서의 기탁과 그 날짜
2) 이 협약의 발효일
3) 이 협약의 폐기서(廢棄書) 기탁과 그 접수일 및 폐기 효력 발생일, 그리고
4) 이 협약에 따라 접수된 그 밖의 선언과 통보, 그리고
나. 이 협약이 발효하는 즉시, 「국제연합헌장」 제102조에 따른 등록 및 공표를 위하여 국제연합 사무국에 그에 대한 전문을 송부한다.
제21조
언어
이 협약은 아랍어, 중국어, 영어, 프랑스어, 러시아어 및 스페인어로 단일 원본으로 작성되며, 각 언어본은 동등하게 정본이다.
2009년 5월 15일 중국 홍콩에서 작성되었다.
이상의 증거로, 아래 서명자는 그들 각자의 정부로부터 정당하게 권한을 위임받아 이 협약에 서명하였다.

안전하고 환경친화적인 선박재활용을 위한 규칙
제1장
일반 규정
제1규칙
정의
이 부속서의 목적상,
1. “권한 있는 사람”이란 특정 작업을 수행하기 위한 적합한 자격, 훈련, 충분한 지식, 경험 및 기술을 가지고 있는 사람을 말한다. 구체적으로, 권한 있는 사람은 숙련된 작업자 또는 관리자로, 선박재활용시설에서의 직무상 위해요소, 위험 및 잠재적으로 유해물질이나 안전하지 않은 여건에 작업자가 노출될 수 있음을 인식하고 평가할 수 있으며, 그러한 위해요소, 위험 또는 노출을 제거하거나 경감하기 위하여 취하는 필요한 보호 및 예방책을 지정할 수 있다. 권한 있는 당국은 그러한 사람을 지정하기 위하여 적절한 기준을 정할 수 있고, 그들에게 주어지는 의무를 결정할 수 있다.
2. “사업자”란 선박재활용에 종사하는 한 명 이상의 작업자를 고용한 자연인 또는 법인을 말한다.
3. “현존선(現存船)”이란 신선(新船)이 아닌 선박을 말한다.
4. “신선”이란 다음의 선박을 말한다.
가. 이 협약의 발효 이후에 선박 건조 계약이 이루어진 선박, 또는
나. 건조 계약이 없는 경우, 용골 거치나 이와 유사한 건조 단계가 협약 발효 후 6개월 이후에 있는 선박, 또는
다. 이 협약의 발효 후 30개월 이후에 인도가 이루어진 선박
5. “신규 설치“란 협약 발효일 후 시스템, 장비, 절연 또는 그 밖의 물질을 선상에 설치하는 것을 말한다.
6. “진입안전”이란 다음의 기준을 충족하는 어떤 공간을 말한다.
가. 대기 산소 함유량 및 가연성 증기 농도가 안전 한계 내에 있을 것
나. 대기 중 어떠한 독성 물질도 허용가능한 농도 내에 있을 것, 그리고
다. 권한 있는 사람이 인증한 작업과 관련된 어떠한 잔존물 또는 물질도 지시된 바에 따라 관리되고 있는 기존 대기 조건하에서 독성 물질이 통제불가능하게 방출되거나 안전하지 못한 가연성 증기 농도가 산출되지 않을 것
7. “화기작업안전”이란 다음의 기준을 충족시키는 어떠한 공간을 말한다.
가. 전기 아크 또는 가스용접 장비, 절단이나 연소 장비의 사용 또는 가열, 연마 또는 스파크뿐만 아니라 그 밖의 형태의 노출 화염을 발생시키는 작업에서의 사용을 위하여, 가스가 제거된 상태를 포함한 안전한 비폭발성 상태일 것
나. 제1규칙제6항의 진입안전 요건이 충족될 것
다. 화기작업으로 인해 기존 대기 조건이 변화하지 않을 것, 그리고
라. 모든 인접한 공간이 화재의 발생이나 확산을 방지할 수 있을 만큼 충분히 소제(掃除)되거나, 불활성화되거나, 처리될 것
8. “선주”란 선박의 소유자로 등록된 사람이나 사람들 또는 회사나, 등록이 안 된 경우 선박을 소유하고 있는 사람이나 사람들 또는 회사나, 관리자 같은 그 밖의 다른 기관 또는 사람이나, 선박 소유주로부터 선박의 운항에 대한 책임을 부담하는 나용선자를 말한다. 그러나 국가가 소유하고 선박의 운영자로 그 국가에 등록된 회사가 운영하는 경우, “선주”란 그러한 회사를 말한다. 이 용어는 선박 매매가 완료될 때까지 또는 선박재활용시설에 선박을 인도할 때까지 제한된 기간 동안 선박의 소유권을 가진 이들도 포함한다.
9. “현장 점검”이란 검증된 서류에 기술된 상태를 확인하는 선박재활용시설에 대한 점검을 말한다.
10. “완료 보고서”란 선박재활용시설이 발행하는 것으로, 선박재활용이 이 협약에 따라 완료되었다는 확인 보고서를 말한다.
11. “탱커”란 선박으로부터의 오염방지를 위한 국제협약의 제1부속서에서 정의된 유조선 또는 선박으로부터의 오염방지를 위한 국제협약의 제2부속서에서 정의된 유해액체물질(NLS) 운반선을 말한다.
12. “작업자”란 계약인력을 포함한 고용 관계에 있어서 정규직 또는 임시직으로 작업을 수행하는 모든 사람을 말한다.
제2규칙
일반 적용
달리 명시적으로 규정되지 않은 경우, 선박의 설계, 건조, 검사, 증서 발행, 운영 및 재활용은 이 부속서의 규정에 따라 수행된다.
제3규칙
그 밖의 기준, 권고 및 지침과의 관계
당사자는, 국제노동기구가 고안한 적용가능한 관련 기준, 권고 및 지침 그리고 「유해 폐기물의 국가간 이동 및 그 처리의 통제에 관한 바젤협약」에 따라 고안된 적용가능한 관련 기술 표준, 권고 및 지침을 고려하여, 이 부속서 규칙의 요건을 이행하기 위한 조치를 한다.
제2장
선박에 대한 요건
제1절
선박의 설계, 건조, 운영 및 유지
제4규칙
선박 유해물질의 통제
이 협약 부록 1에 명시된 요건에 따라, 각 당사자는
1. 자국의 국기를 게양할 권리가 있거나 자국의 권한하에 운영 중인 선박에 부록 1에 열거된 유해물질의 설치나 사용을 금지 및/또는 제한한다. 그리고
2. 당사자의 항만, 조선소, 선박 수리소 또는 연안 터미널에 있는 선박에 그러한 물질의 설치 또는 사용을 금지 및/또는 제한한다.
그리고 해당 선박이 그 요건들에 부합하도록 보장하기 위한 효과적인 조치를 한다.
제5규칙
유해물질목록
1. 각 신선은 유해물질목록을 선상에 비치한다. 그 목록은, 기구가 고안한 지침과 그 지침에 포함된 임계치와 면제를 포함하여, 주관청 또는 주관청이 권한을 부여한 어느 사람 또는 기관에 의하여 검증된다. 이 유해물질목록은 각 선박에 특정되도록 하며, 해당 목록에는 최소한
가. 이 협약의 부록 1 및 2에 열거되고 선박 구조물 또는 장비에 포함된 유해물질과 그 유해물질의 위치 및 대략적인 양을 제1부에서 밝힌다. 그리고
나. 선박이 제4규칙을 준수함을 명확히 한다.
2. 현존선은 이 협약이 발효된 후 5년 이내에 또는 재활용이 이보다 더 빠른 경우 재활용을 하러 가기 전에, 기구가 고안한 지침 그리고 검사 및 증서에 대한 기구의 조화제도를 고려하여, 실행가능한 한 제1항에 부합하도록 한다. 유해물질목록을 고안할 때 최소한 부록 1에 열거된 유해물질은 확인되어야 한다. 현존선의 경우, 기구가 고안한 지침을 고려하여, 유해물질목록이 고안되는 시각/표본 검사를 기술하는 계획을 준비한다.
3. 유해물질목록 제1부는, 기구가 고안한 지침을 고려하여, 부록 2에 열거된 유해물질을 포함하는 새로운 설치 그리고 선박의 구조물 및 장비의 관련 변경을 반영하여 선박의 전 운항 수명 동안 적절하게 유지되고 갱신된다.
4. 재활용 전에 해당 목록에는 적절하게 관리되고 갱신된 제1부와 함께, 운항 중 발생된 폐기물에 관한 제2부 및 물품에 관한 제3부를 포함시키고, 해당 목록은, 기구가 고안한 지침을 고려하여, 주관청 또는 주관청이 권한을 부여한 사람 또는 기관에 의하여 검증된다.
제6규칙
부록 1 및 2의 개정 제안 절차
1. 어떤 당사자든 이 규칙에 따라 부록 1 및/또는 2에 대한 개정을 제안할 수 있다. 제안된 개정은 제18조제2항과 이 규칙에 따라 기구 내에서 심의된다.
2. 기구는 또한, 어떤 안을 접수한 경우, 그 안에 대한 국제연합, 국제연합의 전문기구, 기구와 합의한 정부간 기구 및 기구와 협의하는 지위에 있는 비정부기구의 주의를 환기시키고, 그들이 그 안을 이용할 수 있도록 한다.
3. 위원회는 이 규칙 제1항에 따라 제출된 안을 검토하기 위하여 제7규칙에 따라 기술 그룹을 결성한다.
4. 기술 그룹은 이익단체가 제출한 다른 국제기구의 물질 또는 유해물질목록에 관하여 해당 국제기구가 채택한 결정을 포함한 모든 추가 자료와 함께 해당 안을 검토하며, 부록 1 또는 부록 2의 개정이 타당할 정도로 해당 유해물질이 협약과 관련하여 인간 건강 또는 환경에 중대한 부정적 영향을 미칠 가능성이 큰 지 여부를 평가하고 이를 위원회에 보고한다. 이러한 측면에서
가. 기술 그룹의 검토는 다음을 포함한다.
1) 해당 유해물질과 제출된 자료 또는 해당 그룹의 주의를 환기시킨 그 밖의 관련 자료에 근거하여 인간 건강 또는 환경에 중대한 부정적 영향을 미치게 되는 이 협약상 가능성과의 연관성에 대한 평가
2) 제안된 통제 조치 및 기술 그룹이 고려할 수 있는 그 밖의 통제 조치로 인한 잠재적인 위험 감소에 대한 평가
3) 통제 조치의 기술적 실행가능성에 대한 이용가능한 정보의 심의
4) 해당 통제 조치의 도입으로 인해 발생되는 다음과 관련된 그 밖의 영향에 대한 이용가능한 정보의 심의
- 환경
- 선원과 작업자의 건강 및 안전을 포함한 인간 건강 및 안전, 그리고
- 국제 해운 및 그 밖의 관련 부문에 대한 비용
5) 유해물질에 대한 대체품의 잠재적 위험에 대한 심의를 포함하여, 통제되어야 하는 유해물질에 대한 적합한 대체품의 이용가능성에 대한 심의
6) 재활용 과정에서 유해물질로 인한 위험에 대한 심의, 그리고
7) 적합한 임계치와 유용하거나 필요한 면제에 대한 심의
나. 기술 그룹이 해당 유해물질이, 이 협약과 관련하여, 인간 건강 또는 환경에 중대한 부정적 영향을 미칠 가능성이 큼을 알게 될 경우, 완전한 과학적 확실성의 결여는 해당 그룹이 그 안의 평가를 진행시키는 것을 막는 이유로 이용되어서는 안 된다.
다. 기술 그룹의 보고는 서면으로 하며, 가호에서 언급된 각 평가와 심의를 고려한다. 다만, 기술 그룹이 가호1)목의 평가 후에 그 안을 추가로 심의하는 것이 타당하지 않다고 결정하여, 가호2)목에서 가호7)목까지 기술된 평가 및 심의를 진행하지 않기로 결정할 수 있는 경우에는 그렇지 않다.
라. 기술 그룹의 보고는 특히 이 협약에 따른 국제 통제가 해당 유해물질에 대해서 타당한지 여부에 대한 권고, 포괄적인 안에 제시된 특정 통제 조치의 적합성에 대한 권고 또는 기술 그룹이 좀 더 적합하다고 믿는 그 밖의 통제 조치에 관한 권고를 포함한다.
5. 위원회는, 기술 그룹의 보고를 고려하여, 부록 1 또는 부록 2의 모든 개정안에 대한 승인 여부를 결정하고, 적절한 경우, 그에 대한 모든 변경을 결정한다. 제안된 모든 개정은 개정이 발효되기 전에 이 협약에 따라 증서가 발행된 선박에 대한 개정의 적용을 명시한다. 그 보고가 해당 유해물질이 이 협약과 관련하여 인간 건강 또는 환경에 중대한 부정적 영향을 미칠 가능성이 큼을 알려줄 경우, 완전한 과학적 확실성의 결여는 부록 1 또는 부록 2의 유해물질을 열거하는 결정을 막는 이유로 이용되어서는 안 된다. 새로운 정보가 밝혀질 경우, 그 안을 승인하지 않기로 결정했다고 해서 특정 유해물질에 대한 새로운 안을 장래에 제출하는 것이 배제되지는 않는다.
제7규칙
기술 그룹
1. 위원회는 필요한 경우 제6규칙에 따라 기술 그룹을 하나 이상 설치할 수 있다. 그 기술 그룹은 당사자, 기구 회원, 국제연합과 국제연합의 전문기구, 기구와 합의한 정부간 기구 및 기구와 협의하는 지위에 있는 비정부기구의 대표로 구성될 수 있고, 이 그룹에는 어떠한 안의 기술적 장점을 객관적으로 검토할 필요가 있는 물질의 환경적 거동과 영향, 독성학적 영향, 해양 생물학, 인간의 건강, 경제 분석, 위험 관리, 조선, 국제 해운, 산업안전보건 또는 그 밖의 전문 분야에서 전문성을 가진 연구소 및 실험실의 대표를 우선적으로 포함시키도록 한다.
2. 위원회는 기술 그룹의 위임, 조직, 참여 및 운영 사항에 대하여 결정한다. 그러한 사항에는 제출될 수 있는 기밀정보의 보호를 규정한다. 기술 그룹은 필요한 경우 그러한 회의를 개최할 수 있지만, 적절한 경우, 서면 또는 전자 서신이나 그 밖의 매체를 통하여 작업을 수행하도록 노력한다.
3. 당사자 대표들만 제6규칙에 따라서 위원회에 대한 모든 권고를 작성하는 데 참여할 수 있다. 기술 그룹은 당사자 대표들 간의 만장일치를 성사시키도록 노력한다. 만약 만장일치가 가능하지 않을 경우, 기술 그룹은 당사자 대표들의 소수 의견을 전달한다.
제2절
선박재활용을 위한 준비
제8규칙
일반 요건
재활용 예정인 선박은,
가. 다음과 같은 선박재활용시설에서만 재활용된다.
1) 이 협약에 따라 인증 받은 선박재활용시설, 그리고
2) 선박재활용계획에서 특정 선박재활용시설(들)이 수행하도록 명시한 모든 선박재활용을 실시할 수 있는 완전한 권한을 가진 선박재활용시설
나. 선박재활용시설에 들어가기 전의 기간에 화물잔류물, 잔존 연료유 및 선상 잔존 폐기물의 양을 최소화하기 위한 작업을 실시한다.
다. 탱커의 경우, 선박재활용시설이 운영되는 관할권을 가진 당사자의 국내 법령 및 정책에 따라서 진입안전이나 화기작업안전 또는 둘 모두에 대한 증서 발행이 준비된 상태로 화물 탱크와 펌프실(들)이 있는 선박재활용시설에 도착한다.
라. 제9규칙에 따라 필요한 선박재활용계획을 고안하기 위하여 선박에 관련된 모든 이용가능한 정보를 선박재활용시설에 제공한다.
마. 제5규칙에 따라 필요한 유해물질목록을 완성한다. 그리고
바. 모든 재활용 활동을 하기 전에, 주관청이나 주관청이 인정한 기관을 통하여 재활용 준비가 되었다는 증서를 발행받는다.
제9규칙
선박재활용계획
선박이 특정된 선박재활용계획은 선박재활용시설(들)이 어떠한 선박을 재활용하기 전에 기구가 고안한 지침을 고려하여 고안된다. 그 선박재활용계획은
가. 선주가 제공하는 정보를 고려하여 고안된다.
나. 선박재활용시설을 인증한 당사자가 수락하는 언어로 고안되며, 사용된 언어가 영어, 프랑스어 또는 스페인어가 아닌 경우, 이들 중의 한 언어로 번역되나, 주관청이 이러한 번역이 필요하지 않다고 인정하는 경우는 제외한다.
다. 특히 진입안전 및 화기작업안전 조건의 수립, 유지 및 감시에 관한 정보, 그리고 유해물질목록에서 확인된 물질을 포함한 물질의 유형 및 양이 관리되는 방법을 포함한다.
라. 제16조제6항에 따라 기탁된 선언에 따라 선박재활용시설을 인증한 권한 있는 당국이 명시적으로 또는 암묵적으로 승인한다. 권한 있는 당국은 제24규칙에 따른 선박재활용계획의 접수에 관한 확인서를 자신이 접수한 후 3 근무일 내에 선박재활용시설, 선주 및 주관청에 송부한다. 그런 후,
1) 어떠한 당사자가 선박재활용계획의 명시적 승인을 요구하는 경우, 권한 있는 당국은 선박재활용계획을 승인하거나 거부하는 자신의 결정에 대한 서면 통보를 선박재활용시설, 선주 및 주관청에 송부한다. 그리고
2) 어떠한 당사자가 선박재활용계획의 암묵적 승인을 요구하는 경우, 그 접수 확인서에는 14일 검토 기간의 종료일을 명시한다. 권한 있는 당국은 이러한 14일 검토 기간 내에 선박재활용계획에 대한 모든 서면 이의를 선박재활용시설, 선주 및 주관청에 통보한다. 그러한 서면 이의가 통보되지 않은 경우, 선박재활용계획은 승인된 것으로 간주된다.
마. 라호에 따라 승인된 즉시, 주관청 또는 모든 지명된 검사원이나 주관청이 인정한 기관의 점검을 위하여 이용가능하도록 한다. 그리고,
바. 두 개 이상의 선박재활용시설이 이용되는 경우, 이용될 선박재활용시설을 밝히고, 재활용 활동 및 재활용 활동이 인증된 각 선박재활용시설에서 이루어지는 순서를 명시한다.
제3절
검사 및 증서 발행
제10규칙
검사
1. 이 협약이 적용되는 선박은 아래에 명시된 검사의 대상이 된다.
가. 선박이 취항하기 전 또는 국제유해물질목록증서가 발행되기 전의 최초검사. 이 검사는 제5규칙에 따라 필요한 유해물질목록 제1부가 이 협약의 요건을 따르고 있는지 검증한다.
나. 5년을 넘지 않는 주관청이 명시한 간격으로 이루어지는 정기검사. 이 검사는 제5규칙에 따라 필요한 유해물질목록 제1부가 이 협약의 요건을 준수하고 있는지 검증한다.
다. 구조물, 장비, 시스템, 부착물, 배치 및 물질의 어떠한 변경, 교체 또는 중요한 수리 후 선주의 요구가 있을 시, 전반적 또는 부분적 추가검사가 상황에 따라 있을 수 있다. 해당 검사는 어떠한 그러한 변화, 교체 또는 중요한 수리가 해당 선박이 이 협약의 요건을 계속 준수하는 방식으로 이루어졌음과 유해물질목록 제1부가 필요에 따라 수정됨을 보장한다. 그리고
라. 선박이 운항을 중단하기 전과 선박재활용을 착수하기 전에 이루어지는 최종검사. 이 검사는 다음을 검증한다.
1) 기구가 고안한 지침을 고려하여, 제5규칙제4항에 따라 필요한 유해물질목록이 이 협약의 요건을 따르고 있는지,

3) 해당 선박이 재활용될 선박재활용시설(들)이 이 협약에 따른 유효한 인증을 보유하고 있는지
2. 이 협약 규정의 집행을 목적으로 한 선박 검사는, 기구가 고안한 지침을 고려하여, 주관청 공무원에 의해 수행된다. 다만, 주관청은 그 목적을 위하여 지명된 검사원이나 주관청이 인정한 기관에 검사를 위탁할 수 있다.
3. 제2항에서 기술된 바와 같이 검사를 수행할 검사원을 지명하거나 기관을 인정하는 주관청은 해당 지명된 검사원 또는 인정된 기관에 최소한 다음을 할 수 있는 권한을 부여한다.
가. 그들이 검사하는 어떤 선박이 이 협약의 규정을 준수하도록 요구한다. 그리고
나. 당사자인 항만국의 적절한 당국이 요구한 검사 및 점검을 수행한다.
4. 모든 경우에 해당 주관청은 검사의 완전성 및 효율성을 보장하는데 책임이 있으며, 이러한 의무를 충족시키는 데 필요한 준비가 되도록 보장하기 위하여 노력한다.
5. 최초검사와 정기검사는 기구의 다른 적용가능한 법률 문서에 따라 필요한 검사와 조화를 이루도록 한다.
제11규칙
증서 발행 및 이서
1. 국제유해물질목록증서는, 기구가 고안한 지침을 고려하여, 최초검사와 최종검사 모두 동시에 실시되는 현존선을 제외하고, 제10규칙이 적용되는 모든 선박에 대하여 제10규칙에 따라 최초검사 또는 정기검사가 성공적으로 완료된 후에 주관청이나 주관청이 권한을 부여한 모든 사람 또는 기관에 의해 발행된다.
2. 제1항에 따라 발행된 국제유해물질목록증서는, 선주의 요청이 있을 경우, 제10규칙에 따라 수행된 추가검사가 성공적으로 완료된 후에 주관청 또는 주관청이 권한을 부여한 모든 사람 또는 기관에 의해 이서된다.
3. 제14규칙제2항과 제10규칙제1항나호의 요건에도 불구하고, 기존 증서의 만료일 전 3개월 내에 정기검사가 완료되는 경우, 새 증서는 정기검사의 완료일부터 기존 증서의 만료일로부터 5년을 넘지 않는 일자까지 유효하다.
4. 정기검사가 기존 증서의 만료일 후 완료되는 경우, 새 증서는 정기검사의 완료일부터 기존 증서의 만료일부터 5년을 넘지 않는 일자까지 유효하다.
5. 정기검사가 기존 증서의 만료일 3개월 전에 완료되는 경우, 새 증서는 정기검사의 완료일부터 정기검사의 완료일부터 5년을 넘지 않는 일자까지 유효하다.
6. 어떠한 증서가 5년 미만의 기간으로 발행될 경우, 주관청은 그 증서의 유효성을 만료일을 지나 제10규칙제1항나호에 명시된 최대 기간까지 연장할 수 있다.
7. 정기검사가 완료되었으나 새 증서가 기존 증서의 만료일 전에 발행될 수 없거나 선상에 비치될 수 없을 경우, 주관청이 권한을 부여한 사람 또는 기관은 기존 증서에 이서할 수 있으며, 그러한 증서는 만료일부터 5개월을 넘지 않는 추가 기간 동안 유효한 것으로 인정된다.
8. 어떠한 선박이 어떤 증서가 만료되는 시점에 검사를 받기로 되어 있는 항구에 있지 않는 경우, 주관청은 그 증서의 유효 기간을 연장할 수 있으나, 이러한 연장은 그 선박이 검사를 받기로 되어 있는 항구로 항해를 완료할 수 있도록 허용하는 목적으로만 그리고 그렇게 하는 것이 적당하고 합리적으로 보이는 경우에만 허가된다. 어떠한 증서도 3개월보다 더 긴 기간 동안 연장되지 않으며, 연장이 허가된 선박은 검사를 받기로 되어 있는 항구에 도착한 후, 새 증서 없이는 그러한 연장으로 인해 해당 항구에서 출항할 권리를 가지고 있지는 않다. 정기검사가 완료되는 경우, 새 증서는 연장이 허가되기 전의 기존 증서의 만료일부터 5년을 넘지 않는 일자까지 유효하다.
9. 이 규칙의 전술한 규정들에 따라 연장되지 않은 단거리 항해를 하는 선박에 발행된 증서는, 그 증서에 기재된 만료일부터 1개월까지의 유예기간 동안 주관청에 의하여 연장될 수 있다. 정기검사가 완료되는 경우, 새 증서는 연장이 허가되기 전의 기존 증서의 만료일부터 5년을 넘지 않는 일자까지 유효하다.
10. 특별한 상황에서 주관청이 결정한 바에 따라 새 증서는 이 규칙 제4항, 제8항 또는 제9항에 따라 필요한 기존 증서의 만료일부터는 날짜를 지정할 필요는 없다. 이러한 특별한 상황에서 새 증서는 정기검사 완료일부터 5년을 넘지 않는 일자까지 유효하다.
11. 국제재활용준비증서는, 선박재활용시설의 인증 및 기구가 고안한 지침을 고려하여, 제10규칙이 적용되는 모든 선박에 대하여 제10규칙의 규정들에 따른 최종검사가 성공적으로 완료된 후 주관청 또는 주관청이 권한을 부여한 모든 사람이나 기관에 의하여 발행된다.
12. 어떠한 당사자의 권한하에 발행된 증서는 다른 당사자들에 의하여 인정되어야 하고, 이 협약에 포함된 모든 목적상 그 당사자들이 발행한 증서와 동일한 효력을 지닌다고 본다. 증서는 주관청 또는 주관청이 정당하게 권한을 부여한 모든 사람 또는 기관에 의하여 발행 또는 이서된다. 모든 경우에 주관청은 해당 증서에 대한 전적인 책임을 부담한다.
제12규칙
다른 당사자의 증서 발행 또는 이서
1. 주관청의 요청에 따라 다른 당사자는 선박이 검사를 받도록 할 수 있으며, 이 협약의 규정이 준수되고 있음을 충족시킨 경우, 선박에 대한 증서를 발행하거나 발행할 권한을 부여하고, 적절한 경우, 이 부속서에 따라 해당 선박에 대한 증서에 이서하거나 이서할 권한을 부여한다.
2. 증서 및 검사 보고서의 사본은 가능한 한 조속히 요청한 주관청에 송부한다.
3. 이와 같이 발행된 증서에는 증서가 주관청의 요청에 따라 발행되었고, 주관청에 의하여 발행된 증서와 동일한 효력을 가지며 동일한 것으로 인정된다는 취지의 기재가 포함된다.
4. 당사자가 아닌 국가의 국기를 게양할 권리가 있는 선박에는 증서를 발행하지 않는다.
제13규칙
증서 양식
증서는 발행 당사자의 공식 언어로 부록 3 및 4에 명시된 양식으로 작성된다. 사용된 언어가 영어, 프랑스어 또는 스페인어가 아닌 경우, 본문은 이들 중 한 언어로 된 번역을 포함한다. 그러나 주관청은 이 협약의 다른 당사자의 관할권하의 항구 또는 연안 터미널로 항해하지 않는 선박에는 발행 당사자의 공식 언어로만 작성된 국제유해물질목록증서를 발행할 수 있으며, 발행 당사자의 관할권하의 선박재활용시설에서 재활용된 선박에는 발행 당사자의 공식 언어로만 작성된 국제재활용준비증서를 발행할 수 있다.
제14규칙
증서 기간 및 효력
1. 제11규칙 또는 제12규칙에 따라 발행된 국제유해물질목록증서는 다음의 경우 효력이 중단된다.
가. 유해물질목록 제1부가 기구가 고안한 지침에 따라 선박의 구조물 및 장비의 변경을 반영하여 적절하게 유지되고 갱신되지 않은 경우를 포함하여, 선박의 상태가 해당 증서의 세부사항과 실질적으로 일치하지 않는 경우
나. 다른 기국으로 선박이 양도되는 경우. 새 증서는 해당 새 증서를 발행하는 당사자가 그 선박이 제10규칙의 요건을 준수하고 있음을 완전히 인정할 경우에만 발행된다. 당사자 간의 양도인 경우, 양도가 발생한 후 3개월 내에 요청을 받으면, 이전에 선박에 자국의 국기를 게양할 권리가 있었던 당사자는 양도 전에 선박에 비치된 증서의 사본 그리고, 이용가능한 경우, 관련 검사 보고서의 사본을 가능한 한 조속히 주관청에 송부한다.
다. 제10규칙제1항 및 제11규칙에 따라 명시된 기간 내에 정기검사가 완료되지 않은 경우, 또는
라. 해당 증서가 제11규칙 또는 제12규칙에 따라 이서되지 않은 경우
2. 국제유해물질목록증서는 주관청이 명시한 기간 동안 발행되며, 그 기간은 5년을 넘지 않는다.
3. 국제재활용준비증서는 주관청이 명시한 기간 동안 발행되며, 그 기간은 3개월을 넘지 않는다.
4. 제11규칙 또는 제12규칙에 따라 발행된 국제재활용준비증서는 선박의 상태가 증서의 세부사항과 실질적으로 일치하지 않는 경우 유효성이 중단된다.
5. 국제재활용준비증서는 선박재활용시설까지 단일 지점에서 지점으로의 항해를 위하여 주관청 또는 주관청이 권한을 부여한 사람 또는 기관에 의하여 연장될 수 있다.
제3장
선박재활용시설 요건
제15규칙
선박재활용시설에 대한 통제
1. 각 당사자는 이 협약의 규칙에 따라 안전하고 환경친화적인 방식으로 선박재활용시설이 설계, 건설 및 운영되고 있음을 보장하기 위하여 필요한 법령, 규칙 및 기준을 수립한다.
2. 각 당사자는 선박재활용시설이 이 협약의 요건을 충족시킨다는 것을 보장하는 적절한 조건으로 선박재활용시설을 인증하기 위한 체제를 수립한다.
3. 각 당사자는 선박재활용시설이 진입권 및 표본추출을 포함한 검사, 감시 및 집행 규정의 제정 및 효과적인 이용을 포함하는 제3장의 요건을 준수하는 것을 보장하는 체제를 수립한다. 해당 체제는, 기구가 고안한 지침을 고려하여, 권한 있는 당국(들)이나 당사자가 인정한 기관에 의하여 실시되는 감사계획을 포함할 수 있으며, 이러한 감사의 결과는 기구에 전달되도록 한다.
4. 각 당사자는, 당사자의 관할권 내에 운영되는 선박재활용시설과 관련된 사안에 대하여, 한 개 이상의 권한 있는 당국을 지정하고, 기구, 이 협약의 당사자 및 그 밖의 이해 관계자들이 사용할 단일 연락처를 지정한다.
제16규칙
선박재활용시설의 인증
1. 이 협약이 적용되는 선박 또는 제3조제4항에 따라 유사하게 다루어지는 선박을 재활용하는 선박재활용시설은, 기구가 고안한 지침을 고려하여, 당사자에 의해 인증된다.
2. 인증은 권한 있는 당국(들)에 의해 실시되며, 이 협약에 따라 필요한 문서 및 현장 점검의 검증을 포함한다. 그러나 권한 있는 당국(들)은 자신이 인정하는 기관에 선박재활용시설의 인증을 위탁할 수 있다.
3. 그 당사자는 당사자들에게 회람하기 위하여 인정된 기관에 위임된 권한의 구체적인 책임 및 조건을 기구에 통보한다. 모든 경우에, 권한 있는 당국(들)은 발행된 인증에 대한 전적인 책임을 보유한다.
4. 인증은 부록 5에 규정된 양식으로 작성된다. 사용된 언어가 영어, 프랑스어 또는 스페인어가 아닌 경우, 본문은 이들 중 한 언어로 번역한다.
5. 인증은 당사자가 명시한 기간 동안 유효하며, 그 기간은 5년을 넘지 않는다. 당사자는 인증이 발행, 철회, 정지, 개정 또는 갱신되는 조건을 밝히고, 이러한 조건들을 선박재활용시설에 전달한다. 선박재활용시설이 권한 있는 당국(들) 또는 당국/당국들을 대신하여 운영하는 인정된 기관의 점검을 거부할 경우, 해당 인증은 정지되거나 철회된다.
6. 선박재활용시설에서의 사건 또는 취해진 조치로 인해 인증 조건이 더 이상 충족되지 않은 경우, 선박재활용시설은 권한 있는 당국(들)에 통보한다. 그에 따라 권한 있는 당국(들)은 인증을 정지 또는 철회하거나 선박재활용시설에 시정조치를 요구할 수 있다.
제17규칙
일반 요건
1. 당사자가 인증한 선박재활용시설은, 기구가 고안한 지침을 고려하여, 관련 작업자에게 또는 선박재활용시설의 인근 주민에게 건강상 위험을 초래하지 않고, 선박재활용에 의하여 야기되는 환경에 대한 부정적 영향을 방지, 경감, 최소화 및 실행가능한 정도까지 제거하는 관리 체계, 절차 및 기술을 수립한다.
2. 당사자가 인증한 선박재활용시설은, 이 협약이 적용되는 선박 또는 제3조 제4항에 따라 유사하게 다루어지는 선박에 대하여
가. 다음의 선박만을 수용한다.
1) 이 협약을 준수하는 선박, 또는
2) 이 협약의 요건을 충족시키는 선박
나. 재활용을 위하여 권한을 부여받은 선박만 수용한다. 그리고
다. 그 선박재활용시설에서 선박재활용을 고려하고 있는 선주가 선박재활용시설 인증 문서를 요청하는 경우, 해당 문서를 이용가능하도록 한다.
제18규칙
선박재활용시설계획
당사자가 인증한 선박재활용시설은 선박재활용시설계획을 준비한다. 그 계획은 재활용회사의 이사회 또는 적절한 관리부에 의하여 채택되며, 기구가 고안한 지침을 고려하여, 다음을 포함한다.
가. 선박재활용에 의하여 야기되는 인간의 건강 및 환경에 대한 부정적 영향을 실행가능한 정도까지 최소화하고 제거하는 목표의 수립을 포함하여, 작업자의 안전과 인간의 건강 및 환경의 보호를 보장하는 정책
나. 이 협약에 규정된 요건의 이행, 재활용회사의 정책에 규정된 목표의 달성 그리고 선박재활용 운영에서 사용되는 절차 및 기준의 지속적인 향상을 보장하는 체계
다. 선박재활용 운영을 실시할 때, 사업자와 작업자의 역할 및 책임의 식별
라. 선박재활용시설의 안전하고 환경친화적인 운영을 위한 적절한 정보 및 작업자의 훈련 제공 프로그램
마. 비상 대비와 대응 계획
바. 선박재활용 작업을 감시하는 시스템
사. 선박재활용 활동이 어떻게 실시되는지를 보여주는 기록 유지 체계
아. 작업자의 안전, 인간의 건강 및 환경에 손해를 끼치거나 손해를 끼칠 수 있는 잠재성이 있는 배출, 방출, 사건 및 사고를 보고하는 체계, 그리고
자. 직업병, 사고, 상해 및 작업자의 안전과 인간의 건강에 대한 그 밖의 부정적 영향을 보고하는 체계
이는 기구가 고안한 지침을 고려한다.
제19규칙
인간의 건강 및 환경에 대한 부정적 영향 방지
당사자가 인증한 선박재활용시설은 다음을 위한 절차를 수립하고 활용한다.
가. 선박재활용 전반에 걸쳐 화기작업안전 조건 및 절차가 수립, 유지 및 감시되도록 보장함으로써 폭발, 화재 및 그 밖의 안전하지 않은 상태를 방지하는 절차
나. 선박재활용 전반에 걸쳐 밀폐 공간과 폐쇄 공간을 포함한 선박 공간에서 진입안전 조건 및 절차가 수립, 유지 및 감시되도록 보장함으로써 위험한 대기 및 그 밖의 안전하지 않은 상태에서 야기되는 위해를 방지하는 절차
다. 그 밖의 사고, 직업병, 상해 또는 인간의 건강 및 환경에 대한 그 밖의 부정적 영향을 방지하는 절차, 그리고
라. 선박재활용 전반에 걸쳐 인간의 건강 및/또는 환경에 해를 끼칠 수 있는 유출 또는 배출을 방지하는 절차
이는 기구가 고안한 지침을 고려한다.
제20규칙
유해물질에 대한 안전하고 환경친화적인 관리
1. 당사자가 인증한 선박재활용시설은 제11규칙 또는 제12규칙에 따라 증서가 발행된 선박에 포함된 모든 유해물질이 안전하고 환경친화적으로 제거되도록 보장한다. 재활용 운영을 책임지고 있는 사람(들)과 작업자들은 그들의 업무와 관련 있는 이 협약의 요건을 숙지하고 있어야 하고, 특히 유해물질을 제거하기 전이나 제거하는 중에 유해물질목록과 선박재활용계획을 적극적으로 사용하도록 한다.
2. 당사자가 인증한 선박재활용시설은 특히 다음과 같은 유해물질목록에 상술된 모든 유해물질이, 기구가 고안한 지침을 고려하여, 적절하게 훈련된 장비를 갖춘 작업자가 절단하기 전에 가능한 최대한으로 식별, 분류, 포장 및 제거되도록 보장한다.
가. 유해 액체, 찌꺼기 및 침전물
나. 납, 수은, 카드뮴 및 6가 크롬과 같은 중금속을 포함하는 물질이나 물건
다. 매우 가연성이 높고(높거나) 독성 방출을 야기하는 페인트와 코팅제
라. 석면 및 석면이 포함된 물질
마. 해당 작업 중에 열 유도 장비를 피하도록 보장하면서, 폴리염화비페닐과 폴리염화비페닐을 포함하는 물질
바. 염화불화탄소와 할론, 그리고
사. 위에서 열거되지 않은 선박 구조물의 일부가 아닌 그 밖의 유해물질
3. 당사자가 인증한 선박재활용시설은 선박재활용시설에서 재활용된 선박에서 제거된 모든 유해물질과 폐기물들의 안전하고 환경친화적인 관리를 제공하고 보장한다. 관리와 폐기 장소는 물질에 대한 추가적인 안전하고 환경친화적인 관리를 제공하기 위하여 식별된다.
4. 재활용 활동으로부터 생성된 모든 폐기물은 작업자, 인간의 건강 또는 환경에 위험을 초래하지 않는 적절한 상태에서 재활용이 가능한 물질 및 장비로부터 분리, 분류, 보관되며, 안전하고 환경친화적인 방식으로 폐기물을 취급하고 폐기할 수 있도록 인증받은 폐기물 관리 시설로만 옮겨진다.
제21규칙
비상 대비 및 대응
당사자가 인증한 선박재활용시설은 비상 대비 및 대응 계획을 수립하고 유지한다. 그 계획은 선박재활용시설의 위치와 환경을 고려하여 세워지며, 각 선박재활용 운영과 관련된 활동의 규모와 성격을 고려한다. 이 계획은 또한
가. 비상 시 따라야 할 필요한 장비 및 절차가 마련되어 있고 그러한 훈련이 정기적으로 실시되도록 보장한다.
나. 선박재활용시설에서 비상 상황 시 모든 사람과 환경을 보호하기 위하여 필요한 정보가 제공되고, 내부 의사소통 및 협력이 이루어지도록 보장한다.
다. 관련 권한 있는 당국(들), 인근 지역 및 비상대응서비스와 의사소통을 하고 그에 정보를 제공한다.
라. 응급치료와 의료지원, 소방활동과 선박재활용시설에서의 모든 사람들의 탈출, 오염 방지가 이루어지도록 한다. 그리고,
마. 비상 방지, 대비 및 대응 절차의 정기 훈련을 포함하여 모든 수준에서 그리고 작업자의 권한에 따라 선박재활용시설의 모든 작업자에게 관련 정보 및 훈련을 제공한다.
제22규칙
작업자 안전 및 훈련
1. 당사자가 인증한 선박재활용시설은 다음을 포함하는 조치로 작업자의 안전을 제공한다.
가. 모든 선박재활용 작업에서 필요한 개인 보호장비 및 의복의 이용가능성, 관리 및 사용을 보장한다.
나. 작업자들이 맡은 모든 선박재활용 작업을 안전하게 수행할 수 있도록 하는 훈련 프로그램이 제공되도록 보장한다. 그리고,
다. 선박재활용 작업을 수행하기 전에 선박재활용시설에서 모든 작업자가 적절한 훈련과 숙지과정을 제공받도록 보증한다.
2. 어떠한 당사자가 인증한 선박재활용시설은, 다음을 포함하여, 작업을 위한 개인 보호장비를 제공하고 그 사용을 보장한다.
가. 머리 보호
나. 안면과 눈 보호
다. 손과 발 보호
라. 호흡기보호장비
마. 청력 보호
바. 방사능 오염에 대한 보호장치
사. 낙하물로부터의 보호, 그리고
아. 적절한 의복
3. 당사자가 인증한 선박재활용시설은 작업자 훈련을 제공하는 데 협력할 수 있다. 제22규칙제1항나호에 규정된 훈련 프로그램은, 기구가 고안한 지침을 고려하여,
가. 선박재활용시설의 계약인력 및 피고용인을 포함한 모든 작업자를 대상으로 한다.
나. 권한 있는 사람에 의하여 실시된다.
다. 적절한 간격으로 최초 훈련 및 재훈련을 제공한다.
라. 훈련에 대한 참가자들의 이해력 및 기억력에 대한 참가자 평가를 포함한다.
마. 정기적으로 검토되며, 필요한 경우 변경된다. 그리고
바. 문서화한다.
제23규칙
사건, 사고, 직업병 및 만성적 영향에 대한 보고
1. 당사자가 인증한 선박재활용시설은 작업자의 안전, 인간의 건강 및 환경에 위험을 야기하거나 야기할 수 있는 잠재성을 지닌 모든 사건, 사고, 직업병 또는 만성적 영향을 권한 있는 당국(들)에 보고한다.
2. 보고서는 사건, 사고, 직업병 또는 만성적 영향, 그 원인, 취해진 대응 조치 및 결과와 취해질 시정조치에 대한 설명을 포함한다.

제24규칙
최초 통보와 보고 요건
1. 어떠한 선주는 주관청이 이 협약에 따라 필요한 검사와 증서 발행을 준비할 수 있도록 주관청에 선박을 재활용하고자 하는 의사를 적절한 시간 내에 그리고 서면으로 통보한다.
2. 선박재활용시설은 재활용 선박을 인수하고자 준비할 때, 해당 시설의 권한 있는 당국(들)에 적절한 시간 내에 그리고 서면으로 해당 의사를 통보한다. 통보에는 최소한 다음의 선박 상세사항이 포함된다.
가. 선박이 그 국기를 게양할 권리가 있는 국가의 이름
나. 선박이 그 국가에 등록된 일자
다. 선박의 식별번호(IMO 번호)
라. 신조 인도 시 선체 번호
마. 선명 및 선종
바. 선박 등록항
사. 선주의 이름과 주소 및 IMO에 등록된 선주 식별번호
아. 선박회사의 이름과 주소 및 IMO 선박회사 식별번호
자. 선박에 등급을 매기는 모든 선급협회(들)의 이름

3. 재활용될 예정인 선박이 국제재활용준비증서를 취득한 경우, 선박재활용시설은 해당 시설의 권한 있는 당국(들)에 계획된 선박재활용의 착수를 보고한다. 보고서는 부록 6의 보고서 양식을 따르며, 최소한 국제재활용준비증서의 사본을 포함한다. 선박재활용은 그 보고서의 제출 전에는 착수되지 않는다.

이 협약의 요건에 따라 선박 일부 또는 전체의 재활용이 완료된 경우, 완료 보고서가 재활용시설에 의하여 발행되며, 해당 시설의 권한 있는 당국(들)에 보고된다. 이 보고서는 부록 7에 표시된 바대로 작성되어야 한다. 권한 있는 당국(들)은 보고서의 사본을 해당 선박에 대한 국제재활용준비증서를 발행했던 주관청에 보낸다. 보고서는 선박재활용계획에 따른 부분 또는 전체 선박재활용일로부터 14일 이내에 발행되며, 만약 인간의 건강 및/또는 환경에 피해를 입힌 사건 및 사고가 있을 때에는 그러한 사건 및 사고를 포함한다.

(PCB)
"폴리염화비페닐"은 비페닐 분자(단일 탄소-탄소 결합으로 결합된 두 개의 벤젠 고리)의 수소 원자가 10개의 염소 원자까지 대체될 수 있는 방식으로 형성되는 방향족 화합물을 말한다.
모든 선박에 대하여 폴리염화비페닐을 포함하는 물질의 신규 설치는 금지된다.
방오 화합물 및 시스템
이 부속서의 적용이나 해석 시 발효 중인 「2001년 선박의 유해방오시스템 사용 규제에 관한 국제협약」(AFS 협약)의 부속서 1에 따라 규제되는 방오 화합물 및 시스템
1. 어떠한 선박도 살충물제로서 유기주석 화합물을 포함하고 있는 방오 시스템 또는 AFS 협약에 따라 그 적용 또는 사용이 금지된 그 밖의 방오 시스템을 적용할 수 없다.
2. 어떠한 신선 또는 선박의 신규 설치도 AFS 협약에 부합되지 않는 방식으로 방오 화합물 또는 시스템을 적용하거나 사용하지 않는다.

THE PARTIES TO THIS CONVENTION,
NOTING the growing concerns about safety, health, the environment and welfare matters in the ship recycling industry,
RECOGNIZING that recycling of ships contributes to sustainable development and, as such, is the best option for ships that have reached the end of their operating life,
RECALLING resolution A.962(23), adopted by the Assembly of the International Maritime Organization (Guidelines on Ship Recycling); amendments to the Guidelines adopted by resolution A.980(24); Decision VI/24 of the Sixth Meeting of the Conference of the Parties to the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal, which adopted Technical Guidelines for the Environmentally Sound Management of the Full and Partial Dismantling of Ships; and the Guidelines approved by the 289th session of the Governing Body of the International Labour Office (Safety and Health in Shipbreaking: Guidelines for Asian countries and Turkey),
RECALLING ALSO resolution A.981(24), by which the Assembly of the International Maritime Organization requested the Organization’s Marine Environment Protection Committee to develop a legally-binding instrument on ship recycling,
NOTING ALSO the role of the International Labour Organization in protecting the occupational safety and health of workers involved in ship recycling,
NOTING FURTHER the role of the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and their Disposal in protecting human health and the environment against the adverse effects which may result from such wastes,
MINDFUL of the precautionary approach set out in Principle 15 of the Rio Declaration on Environment and Development and referred to in resolution MEPC.67(37), adopted by the Organization’s Marine Environment Protection Committee on 15 September 1995,
MINDFUL ALSO of the need to promote the substitution of hazardous materials in the construction and maintenance of ships by less hazardous, or preferably, non-hazardous materials, without compromising the ships’ safety, the safety and health of seafarers and the ships’ operational efficiency,
RESOLVED to effectively address, in a legally-binding instrument, the environmental, occupational health and safety risks related to ship recycling, taking into account the particular characteristics of maritime transport and the need to secure the smooth withdrawal of ships that have reached the end of their operating lives,
CONSIDERING that these objectives may best be achieved by the conclusion of an International Convention for the Safe and Environmentally Sound Recycling of Ships,
HAVE AGREED as follows:
ARTICLE 1
General obligations
1Each Party to this Convention undertakes to give full and complete effect to its provisions in order to prevent, reduce, minimize and, to the extent practicable, eliminate accidents, injuries and other adverse effects on human health and the environment caused by Ship Recycling, and enhance ship safety, protection of human health and the environment throughout a ship’s operating life.
2No provision of this Convention shall be interpreted as preventing a Party from taking, individually or jointly, more stringent measures consistent with international law with respect to the safe and environmentally sound recycling of ships in order to prevent, reduce or minimize any adverse effects on human health and the environment.
3Parties shall endeavour to co-operate for the purpose of effective implementation of, compliance with and enforcement of this Convention.
4The Parties undertake to encourage the continued development of technologies and practices which contribute to safe and environmentally sound Ship Recycling.
5The Annex to this Convention forms an integral part of it. Unless expressly provided for otherwise, a reference to this Convention constitutes at the same time a reference to its Annex.
ARTICLE 2
Definitions
For the purposes of this Convention, unless expressly provided otherwise:
1"Convention" means the Hong Kong International Convention for the Safe and Environmentally Sound Recycling of Ships, 2009.
2"Administration" means the Government of the State whose flag the ship is entitled to fly, or under whose authority it is operating.
3"Competent Authority(ies)" means a governmental authority or authorities designated by a Party as responsible, within specified geographical area(s) or area(s) of expertise, for duties related to Ship Recycling Facilities operating within the jurisdiction of that Party as specified in this Convention.
4"Organization" means the International Maritime Organization.
5"Secretary-General" means the Secretary-General of the Organization.
6"Committee" means the Marine Environment Protection Committee of the Organization.
7"Ship" means a vessel of any type whatsoever operating or having operated in the marine environment and includes submersibles, floating craft, floating platforms, self elevating platforms, Floating Storage Units (FSUs), and Floating Production Storage and Offloading Units (FPSOs), including a vessel stripped of equipment or being towed.
8"Gross tonnage" means the gross tonnage (GT) calculated in accordance with the tonnage measurement regulations contained in Annex I to the International Convention on Tonnage Measurement of Ships, 1969, or any successor Convention.
9"Hazardous Material" means any material or substance which is liable to create hazards to human health and/or the environment.
10"Ship Recycling" means the activity of complete or partial dismantling of a ship at a Ship Recycling Facility in order to recover components and materials for reprocessing and re-use, whilst taking care of hazardous and other materials, and includes associated operations such as storage and treatment of components and materials on site, but not their further processing or disposal in separate facilities.
11"Ship Recycling Facility" means a defined area that is a site, yard or facility used for the recycling of ships.
12"Recycling Company" means the owner of the Ship Recycling Facility or any other organization or person who has assumed the responsibility for operation of the Ship Recycling activity from the owner of the Ship Recycling Facility and who on assuming such responsibility has agreed to take over all duties and responsibilities imposed by this Convention.
ARTICLE 3
Application
1Unless expressly provided otherwise in this Convention, this Convention shall apply to:
.1ships entitled to fly the flag of a Party or operating under its authority;
.2Ship Recycling Facilities operating under the jurisdiction of a Party.
2This Convention shall not apply to any warships, naval auxiliary, or other ships owned or operated by a Party and used, for the time being, only on government non-commercial service. However, each Party shall ensure, by the adoption of appropriate measures not impairing operations or operational capabilities of such ships owned or operated by it, that such ships act in a manner consistent, so far as is reasonable and practicable, with this Convention.
3This Convention shall not apply to ships of less than 500 GT or to ships operating throughout their life only in waters subject to the sovereignty or jurisdiction of the State whose flag the ship is entitled to fly. However, each Party shall ensure, by the adoption of appropriate measures, that such ships act in a manner consistent with this Convention, so far as is reasonable and practicable.
4With respect to ships entitled to fly the flag of non-Parties to this Convention, Parties shall apply the requirements of this Convention as may be necessary to ensure that no more favourable treatment is given to such ships.
ARTICLE 4
Controls related to Ship Recycling
1Each Party shall require that ships entitled to fly its flag or operating under its authority comply with the requirements set forth in this Convention and shall take effective measures to ensure such compliance.
2Each Party shall require that Ship Recycling Facilities under its jurisdiction comply with the requirements set forth in this Convention and shall take effective measures to ensure such compliance.
ARTICLE 5
Survey and certification of ships
Each Party shall ensure that ships flying its flag or operating under its authority and subject to survey and certification are surveyed and certified in accordance with the regulations in the Annex.
ARTICLE 6
Authorization of Ship Recycling Facilities
Each Party shall ensure that Ship Recycling Facilities that operate under its jurisdiction and that recycle ships to which this Convention applies, or ships treated similarly pursuant to Article 3.4 of this Convention, are authorized in accordance with the regulations in the Annex.
ARTICLE 7
Exchange of information
For the Ship Recycling Facilities authorized by a Party, such Party shall provide to the Organization if requested and those Parties which request it, relevant information, in regard to this Convention, on which its decision for authorization was based. The information shall be exchanged in a swift and timely manner.
ARTICLE 8
Inspection of ships
1A ship to which this Convention applies may, in any port or offshore terminal of another Party, be subject to inspection by officers duly authorized by that Party for the purpose of determining whether the ship is in compliance with this Convention. Except as provided in paragraph 2, any such inspection is limited to verifying that there is on board either an International Certificate on Inventory of Hazardous Materials or an International Ready for Recycling Certificate, which, if valid, shall be accepted.
2Where a ship does not carry a valid certificate or there are clear grounds for believing that:
.1the condition of the ship or its equipment does not correspond substantially with the particulars of the certificate, and/or Part I of the Inventory of Hazardous Materials; or
.2there is no procedure implemented on board the ship for the maintenance of Part I of the inventory of Hazardous Materials;
a detailed inspection may be carried out taking into account guidelines developed by the Organization.
ARTICLE 9
Detection of violations
1Parties shall co-operate in the detection of violations and the enforcement of the provisions of this Convention.
2When there is sufficient evidence that a ship is operating, has operated or is about to operate in violation of a provision in this Convention, a Party holding the evidence may request an investigation of this ship when it enters the ports or offshore terminals under the jurisdiction of another Party. The report of such an investigation shall be sent to the Party requesting it, to the Administration of the ship concerned and to the Organization, so that action may be taken as appropriate.
3If the ship is detected to be in violation of this Convention, the Party carrying out the inspection may take steps to warn, detain, dismiss, or exclude the ship from its ports. A Party taking such action shall immediately inform the Administration of the ship concerned and the Organization.
4If a request for an investigation is received from any Party, together with sufficient evidence that a Ship Recycling Facility is operating, has operated or is about to operate in violation of any provision of this Convention, a Party should investigate this Ship Recycling Facility operating under its jurisdiction and make a report. The report of any such investigation shall be sent to the Party requesting it, including information on action taken or to be taken, if any, and to the Organization for appropriate action.
ARTICLE 10
Violations
1Any violation of the requirements of this Convention shall be prohibited by national laws and:
.1in the case of a ship, sanctions shall be established under the law of the Administration, wherever the violation occurs. If the Administration is informed of such a violation, by a Party, it shall investigate the matter and may request the reporting Party to furnish additional evidence of the alleged violation. If the Administration is satisfied that sufficient evidence is available to enable proceedings to be brought in respect of the alleged violation, it shall cause such proceedings to be taken as soon as possible, in accordance with its law. The Administration shall promptly inform the Party that reported the alleged violation, as well as the Organization, of any action taken. If the Administration has not taken any action within one year after receiving the information, it shall so inform the Party which reported the alleged violation, and the Organization, of the reasons why no action has been taken;
.2In the case of a Ship Recycling Facility, sanctions shall be established under the law of the Party having jurisdiction over the Ship Recycling Facility. If the Party is informed of such a violation by another Party, it shall investigate the matter and may request the reporting Party to furnish additional evidence of the alleged violation. If the Party is satisfied that sufficient evidence is available to enable proceedings to be brought in respect of the alleged violation, it shall cause such proceedings to be taken as soon as possible, in accordance with its law. The Party shall promptly inform the Party that reported the alleged violation, as well as the Organization, of any action taken. If the Party has not taken any action within one year after receiving the information, it shall inform the Party which reported the alleged violation, and the Organization, of the reasons why no action has been taken.
2Any violation of the requirements of this Convention within the jurisdiction of any Party shall be prohibited and sanctions shall be established under the law of that Party. Whenever such a violation occurs, that Party shall either:
.1 cause proceedings to be taken in accordance with its law; or
.2furnish to the Administration of the ship such information and evidence as may be in its possession that a violation has occurred.
3The sanctions provided for by the laws of a Party pursuant to this Article shall be adequate in severity to discourage violations of this Convention wherever they occur.
ARTICLE 11
Undue delay or detention of ships
1All possible efforts shall be made to avoid a ship being unduly detained or delayed under Article 8, 9 or 10 of this Convention.
2When a ship is unduly detained or delayed under Article 8, 9 or 10 of this Convention, it shall be entitled to compensation for any loss or damage suffered.
ARTICLE 12
Communication of information
Each Party shall report to the Organization and the Organization shall disseminate, as appropriate, the following information:
.1a list of Ship Recycling Facilities authorized in accordance with this Convention and operating under the jurisdiction of that Party;
.2contact details for the Competent Authority(ies), including a single contact point, for that Party;
.3a list of the recognized organizations and nominated surveyors which are authorized to act on behalf of that Party in the administration of matters relating to the control of Ship Recycling in accordance with this Convention, and the specific responsibilities and conditions of the authority delegated to the recognized organizations or nominated surveyors;
.4an annual list of ships flying the flag of that Party, to which an International Ready for Recycling Certificates has been issued, including the Recycling Company name and location of the Ship Recycling Facility as shown on the certificate;
.5an annual list of ships recycled within the jurisdiction of that Party;
.6information concerning violations of this Convention; and
.7actions taken towards ships and Ship Recycling Facilities under the juridiction of that Party.
ARTICLE 13
Technical assistance and co-operation
1Parties undertake, directly or through the Organization and other international bodies, as appropriate, in respect of the safe and environmentally sound recycling of ships, to provide support for those Parties which request technical assistance:
.1to train personnel;
.2to ensure the availability of relevant technology, equipment and facilities;
.3to initiate joint research and development programmes; and
.4to undertake other actions aimed at the effective implementation of this Convention and of guidelines developed by the Organization related thereto.
2Parties undertake to co-operate actively, subject to their national laws, regulations and policies, in the transfer of management systems and technology in respect of the safe and environmentally sound recycling of ships.
ARTICLE 14
Dispute settlement
Parties shall settle any dispute between them concerning the interpretation or application of this Convention by negotiation or any other peaceful means agreed upon by them, which may include enquiry, mediation, conciliation, arbitration, judicial settlement, or resort to regional agencies or arrangements.
ARTICLE 15
Relationship with international law and other international agreements
1Nothing in this Convention shall prejudice the rights and obligations of any State under the United Nations Convention on the Law of the Sea, 1982, and under the customary international law of the sea.
2Nothing in this Convention shall prejudice the rights and obligations of Parties under other relevant and applicable international agreements.
ARTICLE 16
Signature, ratification, acceptance, approval and accession
1This Convention shall be open for signature by any State at the Headquarters of the Organization from 1 September 2009 to 31 August 2010 and shall thereafter remain open for accession by any State.
2States may become Parties to this Convention by:
.1signature not subject to ratification, acceptance, or approval; or
.2signature subject to ratification, acceptance, or approval, followed by ratification, acceptance or approval; or
.3accession.
3Ratification, acceptance, approval or accession shall be effected by the deposit of an instrument to that effect with the Secretary-General.
4If a State comprises two or more territorial units in which different systems of law are applicable in relation to matters dealt with in this Convention, it may at the time of signature, ratification, acceptance, approval, or accession declare that this Convention shall extend to all its territorial units or only to one or more of them and may modify this declaration by submitting another declaration at any time.
5A declaration under paragraph 4 shall be notified to the Secretary-General in writing and shall state expressly the territorial unit or units to which this Convention applies.
6A State at the time it expresses its consent to be bound by this Convention shall declare whether it requires explicit or tacit approval of the Ship Recycling Plan before a ship may be recycled in its authorized Ship Recycling Facility(ies). This declaration may be revised thereafter by notification to the Secretary-General. Such revision shall specify the effective date of the revision.
ARTICLE 17
Entry into force
1.This Convention shall enter into force 24 months after the date on which the following conditions are met:
.1not less than 15 States have either signed it without reservation as to ratification, acceptance or approval, or have deposited the requisite instrument of ratification, acceptance, approval or accession in accordance with Article 16;
.2the combined merchant fleets of the States mentioned in paragraph 1.1 constitutes not less than 40 per cent of the gross tonnage of the world’s merchant shipping; and
.3the combined maximum annual ship recycling volume of the States mentioned in paragraph 1.1 during the preceding 10 years constitutes not less than 3 per cent of the gross tonnage of the combined merchant shipping of the same States.
2For States which have deposited an instrument of ratification, acceptance, approval or accession in respect of this Convention after the requirements for entry into force thereof have been met, but prior to the date of entry into force, the ratification, acceptance, approval or accession shall take effect on the date of entry into force of this Convention, or three months after the date of deposit of the instrument, whichever is the later date.
3Any instrument of ratification, acceptance, approval or accession deposited after the date on which this Convention enters into force shall take effect three months after the date of deposit.
4After the date on which an amendment to this Convention is deemed to have been accepted under Article 18, any instrument of ratification, acceptance, approval or accession deposited shall apply to the Convention, as amended.
ARTICLE 18
Amendments
1This Convention may be amended by either of the procedures specified in the following paragraphs.
2Amendments after consideration within the Organization:
.1Any Party may propose an amendment to this Convention. A proposed amendment shall be submitted to the Secretary-General, who shall then circulate it to the Parties and Members of the Organization at least six months prior to its consideration.
.2An amendment proposed and circulated as above shall be referred to the Committee for consideration. Parties, whether or not Members of the Organization, shall be entitled to participate in the proceedings of the Committee for consideration and adoption of the amendment.
.3Amendments shall be adopted by a two-thirds majority of the Parties present and voting in the Committee, on condition that at least one-third of the Parties shall be present at the time of voting.
.4Amendments adopted in accordance with subparagraph 3 shall be communicated by the Secretary-General to the Parties for acceptance.
.5An amendment shall be deemed to have been accepted in the following circumstances:
.5.1An amendment to an article of this Convention shall be deemed to have been accepted on the date on which two-thirds of the Parties have notified the Secretary-General of their acceptance of it.
.5.2An amendment to the Annex shall be deemed to have been accepted at the end of a period to be determined by the Committee at the time of its adoption, which period shall not be less than ten months after the date of adoption. However, if by that date more than one-third of the Parties notify the Secretary-General that they object to the amendment, it shall be deemed not to have been accepted.
.6An amendment shall enter into force under the following conditions:
.6.1An amendment to an article of this Convention shall enter into force, for those Parties that have declared that they have accepted it, six months after the date on which it is deemed to have been accepted in accordance with subparagraph .5.1.
.6.2An amendment to the Annex shall enter into force with respect to all Parties six months after the date on which it is deemed to have been accepted, except for any Party that has:
.6.2.1notified its objection to the amendment in accordance with subparagraph .5.2 and that has not withdrawn such objection; or
.6.2.2notified the Secretary-General, prior to the entry into force of such amendment, that the amendment shall enter into force for it only after a subsequent notification of its acceptance.
.6.3A Party that has notified an objection under subparagraph .6.2.1 may subsequently notify the Secretary-General that it accepts the amendment. Such amendment shall enter into force for such Party six months after the date of its notification of acceptance, or the date on which the amendment enters into force, whichever is the later date.
.6.4If a Party that has made a notification referred to in subparagraph .6.2.2 notifies the Secretary-General of its acceptance with respect to an amendment, such amendment shall enter into force for such Party six months after the date of its notification of acceptance, or the date on which the amendment enters into force, whichever is the later date.
3Amendment by a Conference:
.1Upon the request of a Party concurred in by at least one-third of the Parties, the Organization shall convene a Conference of Parties to consider amendments to this Convention.
.2An amendment adopted by such a Conference by a two-thirds majority of the Parties present and voting shall be communicated by the Secretary-General to all Parties for acceptance.
.3Unless the Conference decides otherwise, the amendment shall be deemed to have been accepted and shall enter into force in accordance with the procedures specified in paragraphs 2.5 and 2.6 respectively.
4Any Party that has declined to accept an amendment to the Annex shall be treated as a non-Party only for the purpose of application of that amendment.
5Any notification under this Article shall be made in writing to the Secretary-General.
6The Secretary-General shall inform the Parties and Members of the Organization of:
.1any amendment that enters into force and the date of its entry into force generally and for each Party; and
.2any notification made under this Article.
ARTICLE 19
Denunciation
1This Convention may be denounced by any Party at any time after the expiry of two years from the date on which this Convention enters into force for that Party.
2Denunciation shall be effected by written notification to the Secretary-General, to take effect one year after receipt or such longer period as may be specified in that notification.
ARTICLE 20
Depositary
1This Convention shall be deposited with the Secretary-General, who shall transmit certified copies of this Convention to all States which have signed this Convention or acceded thereto.
2In addition to the functions specified elsewhere in this Convention, the Secretary-General shall:
.1inform all States that have signed this Convention, or acceded thereto, of:
.1.1 each new signature or deposit of an instrument of ratification, acceptance, approval or accession, together with the date thereof;
.1.2 the date of entry into force of this Convention;
.1.3 the deposit of any instrument of denunciation from this Convention, together with the date on which it was received and the date on which the denunciation takes effect; and
.1.4 other declarations and notifications received pursuant to this Convention; and
.2as soon as this Convention enters into force, transmit the text thereof to the Secretariat of the United Nations, for registration and publication in accordance with Article 102 of the Charter of the United Nations.
ARTICLE 21
Languages
This Convention is established in a single original in the Arabic, Chinese, English, French, Russian and Spanish languages, each text being equally authentic.

ANNEX
REGULATIONS FOR SAFE AND ENVIRONMENTALLY SOUND RECYCLING OF SHIPS
CHAPTER 1 - GENERAL PROVISIONS
Regulation 1 - Definitions
For the purposes of this Annex:
1"Competent person" means a person with suitable qualifications, training, and sufficient knowledge, experience and skill, for the performance of the specific work. Specifically, a Competent person may be a trained worker or a managerial employee capable of recognizing and evaluating occupational hazards, risks, and employee exposure to potentially Hazardous Materials or unsafe conditions in a Ship Recycling Facility, and who is capable of specifying the necessary protection and precautions to be taken to eliminate or reduce those hazards, risks, or exposures. The Competent Authority may define appropriate criteria for the designation of such persons and may determine the duties to be assigned to them.
2"Employer" means a natural or legal person that employs one or more workers engaged in Ship Recycling.
3"Existing ship" means a ship which is not a new ship.
4"New ship" means a ship:
.1for which the building contract is placed on or after the entry into force of this Convention; or
.2in the absence of a building contract, the keel of which is laid or which is at a similar stage of construction on or after six months after the entry into force of this Convention; or
.3the delivery of which is on or after 30 months after the entry into force of this Convention.
5"New installation" means the installation of systems, equipment, insulation, or other material on a ship after the date on which this Convention enters into force.
6“Safe-for-entry” means a space that meets the following criteria:
.1the oxygen content of the atmosphere and the concentration of flammable vapours are within safe limits;
.2any toxic materials in the atmosphere are within permissible concentration; and
.3any residues or materials associated with the work authorized by the Competent person will not produce uncontrolled release of toxic materials or an unsafe concentration of flammable vapours under existing atmospheric conditions while maintained as directed.
7“Safe-for-hot work” means a space that meets the following criteria:
.1a safe, non-explosive condition, including gas-free status, exists for the use of electric arc or gas welding equipment, cutting burning equipment or other forms of naked flame, as well as heating, grinding, or spark generating operations;
.2Safe-for-entry requirements of regulation 1.6 are met;
.3existing atmospheric conditions will not change as a result of the hot work; and
.4all adjacent spaces have been cleaned, or inerted, or treated sufficiently to prevent the start or spread of fire.
8"Shipowner" means the person or persons or company registered as the owner of the ship or, in the absence of registration, the person or persons or company owning the ship or any other organization or person such as the manager, or the bareboat charterer, who has assumed the responsibility for operation of the ship from the owner of the ship. However, in the case of a ship owned by a State and operated by a company which in that State is registered as the ship’s operator, "owner" shall mean such company. This term also includes those who have ownership of the ship for a limited period pending its sale or handing over to a Ship Recycling Facility.
9"Site inspection" means an inspection of the Ship Recycling Facility confirming the condition described by the verified documentation.
10"Statement of Completion" means a confirmatory statement issued by the Ship Recycling Facility that the Ship Recycling has been completed in accordance with this Convention.
11"Tanker" means an oil tanker as defined in MARPOL Annex Ⅰ or an NLS tanker as defined MARPOL Annex Ⅱ.
12"Worker" means any person who performs work, either regularly or temporarily, in the context of an employment relationship including contractor personnel.
Regulation 2 - General applicability
Unless expressly provided otherwise, the design, construction, survey, certification, operation and recycling of ships shall be conducted in accordance with the provisions of this Annex.
Regulation 3 - Relationship with other standards, recommendations and guidance
Parties shall take measures to implement the requirements of the regulations of this Annex, taking into account relevant and applicable standards, recommendations and guidance developed by the International Labour Organization and the relevant and applicable technical standards, recommendations and guidance developed under the Basel Convention on the Control of Transboundary Movements of Hazardous Wastes and Their Disposal.
CHAPTER 2 - REQUIREMENTS FOR SHIPS
Part A - Design, construction, operation and maintenance of ships
Regulation 4 - Controls of ships’ Hazardous Materials
In accordance with the requirements specified in Appendix 1 to this Convention each Party:
.1shall prohibit and/or restrict the installation or use of Hazardous Materials listed in Appendix 1 on ships entitled to fly its flag or operating under its authority; and
.2shall prohibit and/or restrict the installation or use of such materials on ships, whilst in its ports, shipyards, ship repair yards, or offshore terminals,
and shall take effective measures to ensure that such ships comply with those requirements.
Regulation 5 - Inventory of Hazardous Materials
1Each new ship shall have onboard an Inventory of Hazardous Materials. The Inventory shall be verified either by the Administration or by any person or organization authorized by it taking into account guidelines, including any threshold values and exemptions contained in those guidelines, developed by the Organization. The Inventory of Hazardous Materials shall be specific to each ship and shall at least:
.1identify as Part I, Hazardous Materials listed in Appendices 1 and 2 to this Convention and contained in ship’s structure or equipment, their location and approximate quantities; and
.2clarify that the ship complies with regulation 4.
2Existing ships shall comply as far as practicable with paragraph 1 not later than 5 years after the entry into force of this Convention, or before going for recycling if this is earlier, taking into account the guidelines developed by the Organization and the Organization’s Harmonized System of Survey and Certification. The Hazardous Materials listed in Appendix 1, at least, shall be identified when the Inventory is developed. For existing ships a plan shall be prepared describing the visual/sampling check by which the Inventory of Hazardous Materials is developed, taking into account the guidelines developed by the Organization.
3Part I of the Inventory of Hazardous Materials shall be properly maintained and updated throughout the operational life of the ship, reflecting new installations containing Hazardous Materials listed in Appendix 2 and relevant changes in ship structure and equipment, taking into account the guidelines developed by the Organization.
4Prior to recycling the Inventory shall, in addition to the properly maintained and updated Part I, incorporate Part II for operationally generated wastes, and Part III for stores, and be verified either by the Administration or by any person or organization authorized by it, taking into account the guidelines developed by the Organization.
Regulation 6 - Procedure for proposing amendments to Appendices 1 and 2
1Any Party may propose an amendment to Appendix 1 and/or Appendix 2 in accordance with this regulation. The proposed amendment shall be considered within the Organization under Article 18 paragraph 2 and this regulation.
2When the Organization receives a proposal, it shall also bring the proposal to the attention of the United Nations and its Specialized Agencies, intergovernmental organizations having agreements with the Organization and non-governmental organizations in consultative status with the Organization and shall make it available to them.
3The Committee shall establish a technical group in accordance with regulation 7 to review proposals submitted in accordance with paragraph 1 of this regulation.
4The technical group shall review the proposal along with any additional data, including decisions adopted by other international bodies regarding their lists of materials or hazardous substances, submitted by any interested entity and shall evaluate and report to the Committee whether the Hazardous Material in question is likely, in the context of this Convention, to lead to significant adverse effects on human health or the environment such that the amendment of Appendix 1 or Appendix 2 is warranted. In this regard:
.1The technical group’s review shall include:
.1.1an evaluation of the association between the Hazardous Material in question and the likelihood, in the context of this Convention, that will lead to significant adverse effects on human health or the environment based on the submitted data or other relevant data brought to the attention of the group;
.1.2an evaluation of the potential risk reduction attributable to the proposed control measures and any other control measures that may be considered by the technical group;
.1.3consideration of available information on the technical feasibility of control measures;
.1.4consideration of available information on other effects arising from the introduction of such control measures relating to:
- the environment;
- human health and safety including that of seafarers and workers; and
- the cost to international shipping and other relevant sectors.
.1.5consideration of the availability of suitable alternatives to the Hazardous Material to be controlled, including a consideration of the potential risks of alternatives;
.1.6consideration of the risks posed by the Hazardous Material during the recycling process; and
.1.7consideration of suitable threshold values and any useful or necessary exemptions.
.2If the technical group finds that the Hazardous Material in question is likely, in the context of this Convention, to lead to significant adverse effects on human health or the environment, lack of full scientific certainty shall not be used as a reason to prevent the group from proceeding with an evaluation of the proposal.
.3The technical group’s report shall be in writing and shall take into account each of the evaluations and considerations referred to in subparagraph .1, except that the technical group may decide not to proceed with the evaluations and considerations described in subparagraph .1.2 through .1.7 if it determines after the evaluation in subparagraph .1.1 that the proposal does not warrant further consideration.
.4The technical group’s report shall include, inter alia, a recommendation on whether international controls pursuant to this Convention are warranted on the Hazardous Material in question, on the suitability of the specific control measures suggested in the comprehensive proposal, or on other control measures which it believes to be more suitable.
5The Committee shall decide whether to approve any proposal to amend Appendix 1 or Appendix 2, and any modifications thereto, if appropriate, taking into account the technical group’s report. Any proposed amendment shall specify the application of the amendment for ships certified in accordance with this Convention before the entry into force of the amendment. If the report finds that the Hazardous Material in question is likely, in the context of this Convention, to lead to significant adverse effects on human health or the environment, lack of full scientific certainty shall not be used as a reason to prevent a decision from being taken to list a Hazardous Material in Appendix 1 or Appendix 2. A decision not to approve the proposal shall not preclude future submission of a new proposal with respect to a particular Hazardous Material if new information comes to light.
Regulation 7 - Technical Groups
1The Committee may establish one or more technical groups pursuant to regulation 6 as needed. The technical group may comprize representatives of the Parties, Members of the Organization, the United Nations and its Specialized Agencies, intergovernmental organizations having agreements with the Organization, and non-governmental organizations in consultative status with the Organization, which should preferably include representatives of institutions and laboratories with expertise in environmental fate and effects of substances, toxicological effects, marine biology, human health, economic analysis, risk management, shipbuilding, international shipping, occupational health and safety or other fields of expertise necessary to objectively review the technical merits of a proposal.
2The Committee shall decide on the terms of reference, organization, participation and operation of the technical groups. Such terms shall provide for protection of any confidential information that may be submitted. Technical groups may hold such meetings as required, but shall endeavour to conduct their work through written or electronic correspondence or other media as appropriate.
3Only the representatives of Parties may participate in formulating any recommendation to the Committee pursuant to regulation 6. A technical group shall endeavour to achieve unanimity among the representatives of the Parties. If unanimity is not possible, the technical group shall communicate any minority views of such representatives.
Part B - Preparation for Ship Recycling
Regulation 8 - General requirements
Ships destined to be recycled shall:
.1only be recycled at Ship Recycling Facilities that are:
.1authorized in accordance with this Convention; and
.2fully authorized to undertake all the ship recycling which the Ship Recycling Plan specifies to be conducted by the identified Ship Recycling Facility(ies);
.2conduct operations in the period prior to entering the Ship Recycling Facility in order to minimize the amount of cargo residues, remaining fuel oil, and wastes remaining on board;
.3in the case of a tanker, arrive at the Ship Recycling Facility with cargo tanks and pump room(s) in a condition that is ready for certification as safe-for-entry, or safe-for-hot work, or both, according to national laws, regulations and policies of the Party under whose jurisdiction the Ship Recycling Facility operates;
.4provide to the Ship Recycling Facility all available information relating to the ship for the development of the Ship Recycling Plan required by regulation 9;
.5complete the Inventory required by regulation 5; and
.6be certified as ready for recycling by the Administration or organization recognized by it, prior to any recycling activity taking place.
Regulation 9 - Ship Recycling Plan
A ship-specific Ship Recycling Plan shall be developed by the Ship Recycling Facility(ies) prior to any recycling of a ship, taking into account the guidelines developed by the Organization. The Ship Recycling Plan shall:
.1be developed taking into account information provided by the shipowner;
.2be developed in the language accepted by the Party authorizing the Ship Recycling Facility, and if the language used is neither English, French nor Spanish, the Ship Recycling Plan shall be translated into one of these languages, except where the Administration is satisfied that this is not necessary;
.3include information concerning inter alia, the establishment, maintenance, and monitoring of Safe-for-entry and Safe-for-hot work conditions and how the type and amount of materials including those identified in the Inventory of Hazardous Materials will be managed;
.4in accordance with the declaration deposited pursuant to Article 16.6, be either explicitly or tacitly approved by the Competent Authority authorizing the Ship Recycling Facility. The Competent Authority shall send written acknowledgement of receipt of the Ship Recycling Plan to the Ship Recycling Facility, Ship Owner and Administration within three (3) working days of its receipt in accordance with regulation 24. Thereafter:
.1where a Party requires explicit approval of the Ship Recycling Plan, the Competent Authority shall send written notification of its decision to approve or deny the Ship Recycling Plan to the Ship Recycling Facility, Ship Owner and Adminstration; and
.2where a Party requires tacit approval of the Ship Recycling Plan, the acknowledgement of receipt shall specify the end date of a 14 day review period. The Competent Authority shall notify any written objection to the Ship Recycling Plan to the Ship Recycling Facility, Ship Owner and Adminstration within this 14 day review period. Where no such written objection has been notified, the Ship Recycling Plan shall be deemed to be approved.
.5 once approved in accordance with paragraph .4, be made available for inspection by the Administration, or any nominated surveyors or organization recognized by it; and
.6 where more than one Ship Recycling Facility is used, identify the Ship Recycling Facilities to be used and specify the recycling activities and the order in which they occur at each authorized Ship Recycling Facility.
Part C - Surveys and certification
Regulation 10 - Surveys
1Ships to which this Convention applies shall be subject to the surveys specified below:
.1an initial survey before the ship is put in service, or before the International Certificate on Inventory of Hazardous Materials is issued. This survey shall verify that Part I of the Inventory required by regulation 5 is in accordance with the requirements of this Convention;
.2a renewal survey at intervals specified by the Administration, but not exceeding five years. This survey shall verify that Part I of the Inventory of Hazardous Materials required by regulation 5 complies with the requirements of this Convention;
.3an additional survey, either general or partial, according to the circumstances, may be made at the request of the shipowner after a change, replacement, or significant repair of the structure, equipment, systems, fittings, arrangements and material. The survey shall be such as to ensure that any such change, replacement, or significant repair has been made in the way that the ship continues to comply with the requirements of this Convention, and that Part I of the Inventory is amended as necessary; and
.4a final survey prior to the ship being taken out of service and before the recycling of the ship has started. This survey shall verify:
.1that the Inventory of Hazardous Materials as required by regulation 5.4 is in accordance with the requirements of this Convention taking into account the guidelines developed by the Organization;
.2that the Ship Recycling Plan, as required by regulation 9, properly reflects the information contained in the Inventory of Hazardous Materials as required by regulation 5.4 and contains information concerning the establishment, maintenance and monitoring of safe-for-entry and safe-for-hot work conditions; and
.3that the Ship Recycling Facility(ies) where the ship is to be recycled holds a valid authorization in accordance with this Convention.
2Surveys of ships for the purpose of enforcement of the provisions of this Convention shall be carried out by officers of the Adminstration, taking into account the guidelines developed by the Organization. The Administration may, however, entrust the surveys either to surveyors nominated for the purpose or to organizations recognized by it.
3An Administration nominating surveyors or recognizing organizations to conduct surveys, as described in paragraph 2 shall, as a minimum, empower such nominated surveyors or recognized organizations to:
.1require a ship that they survey to comply with the provisions of this Convention; and
.2carry out surveys and inspections if requested by the appropriate authorities of a port State that is a Party.
4In every case, the Administration concerned shall be responsible to ensure the completeness and efficiency of the survey and shall undertake to ensure the necessary arrangements to satisfy this obligation.
5The initial and renewal surveys should be harmonized with the surveys required by other applicable statutory instruments of the Organization.
Regulation 11 - Issuance and endorsement of certificates
1An International Certificate on Inventory of Hazardous Materials shall be issued either by the Administration or by any person or organization authorized by it after successful completion of an initial or renewal survey conducted in accordance with regulation 10, to any ships to which regulation 10 applies, except for existing ships for which both an initial survey and a final survey are conducted at the same time, taking into account the guidelines developed by the Organization.
2The International Certificate on Inventory of Hazardous Materials issued under paragraph 1, at the request of the shipowner, shall be endorsed either by the Administration or by any person or organization authorized by it after successful completion of an additional survey conducted in accordance with regulation 10.
3Notwithstanding regulation 14.2 and the requirements of regulation 10.1.2, when the renewal survey is completed within three months before the expiry date of the existing certificate, the new certificate shall be valid from the date of completion of the renewal survey to a date not exceeding five years from the date of expiry of the existing certificate.
4When the renewal survey is completed after the expiry date of the existing certificate, the new certificate shall be valid from the date of completion of the renewal survey to a date not exceeding five years from the date of expiry of the existing certificate.
5When the renewal survey is completed more than three months before the expiry date of the existing certificate, the new certificate shall be valid from the date of completion of the renewal survey to a date not exceeding five years from the date of completion of the renewal survey.
6If a certificate is issued for a period of less than five years, the Administration may extend the validity of the certificate beyond the expiry date to the maximum period specified in regulation 10.1.2.
7If a renewal survey has been completed and a new certificate cannot be issued or placed on board the ship before the expiry date of the existing certificate, the person or organization authorized by the Administration may endorse the existing certificate and such a certificate shall be accepted as valid for a further period which shall not exceed five months from the expiry date.
8If a ship at the time when a certificate expires is not in a port in which it is to be surveyed, the Administration may extend the period of validity of the certificate but this extension shall be granted only for the purpose of allowing the ship to complete its voyage to the port in which it is to be surveyed and then only in cases where it appears proper and reasonable to do so. No certificate shall be extended for a period longer than three months, and a ship to which an extension is granted shall not, on its arrival in the port in which it is to be surveyed, be entitled by virtue of such extension to leave that port without having a new certificate. When the renewal survey is completed, the new certificate shall be valid to a date not exceeding five years from the date of expiry of the existing certificate before the extension was granted.
9A certificate issued to a ship engaged on short voyages which has not been extended under the foregoing provisions of this regulation may be extended by the Administration for a period of grace of up to one month from the date of expiry stated on it. When the renewal survey is completed, the new certificate shall be valid to a date not exceeding five years from the date of expiry of the existing certificate before the extension was granted.
10In special circumstances, as determined by the Administration, a new certificate need not be dated from the date of expiry of the existing certificate as required by paragraphs 4, 8 or 9 of this regulation. In these special circumstances, the new certificate shall be valid to a date not exceeding five years from the date of completion of the renewal survey.
11An International Ready for Recycling Certificate shall be issued either by the Administration or by any person or organization authorized by it, after successful completion of a final survey in accordance with the provisions of regulation 10, to any ships to which regulation 10 applies, taking into account the authorization of the Ship Recycling Facility and the guidelines developed by the Organization.
12A certificate issued under the authority of a Party shall be accepted by the other Parties and regarded for all purposes covered by this Convention as having the same validity as a certificate issued by them. Certificates shall be issued or endorsed either by the Administration or by any person or organization duly authorized by it. In every case, the Administration assumes full responsibility for the certificate.
Regulation 12 - Issuance or endorsement of a certificate by another Party
1At the request of the Administration, another Party may cause a ship to be surveyed and, if satisfied that the provisions of this Convention are complied with, shall issue or authorize the issuance of a certificate to the ship, and where appropriate, endorse or authorize the endorsement of that certificate on the ship, in accordance with this Annex.
2A copy of the certificate and a copy of the survey report shall be transmitted as soon as possible to the requesting Administration.
3A certificate so issued shall contain a statement to the effect that it has been issued at the request of the Administration and it shall have the same force and receive the same recognition as a certificate issued by the Administration.
4No certificate shall be issued to a ship entitled to fly the flag of a State which is not a Party.
Regulation 13 - Form of the certificates
The certificates shall be drawn up in the official language of the issuing Party, in the form set forth in Appendices 3 and 4. If the language used is neither English, French nor Spanish, the text shall include a translation into one of these languages. The Administration may, however, issue the International Certificate on Inventory of Hazardous Materials drawn up only in the official language of the issuing Party to ships not engaged in voyages to ports or offshore terminals under the jurisdiction of other Parties to this Convention and the International Ready for Recycling Certificate drawn up only in the official language of the issuing Party to ships recycled in Ship Recycling Facilities under the jurisdiction of the issuing Party.
Regulation 14 - Duration and validity of the certificates
1An International Certificate on Inventory of Hazardous Materials issued under regulation 11 or 12 shall cease to be valid in any of the following cases:
.1 if the condition of the ship does not correspond substantially with the particulars of the certificate, including where Part I of the Inventory of Hazardous Materials is not properly maintained and updated, reflecting changes in ship structure and equipment, in accordance with the guidelines developed by the Organization;
.2 upon transfer of the ship to the flag of another State. A new certificate shall only be issued when the Party issuing the new certificate is fully satisfied that the ship is in compliance with the requirements of regulation 10. In the case of a transfer between Parties, if requested within three months after the transfer has taken place, the Party whose flag the ship was formerly entitled to fly shall, as soon as possible, transmit to the Administration copies of the certificates carried by the ship before the transfer and, if available, copies of the relevant survey reports;
.3 if the renewal survey is not completed within the periods specified under regulations 10.1 and 11; or
.4 if the certificate is not endorsed in accordance with regulation 11 or 12.
2An International Certificate on Inventory of Hazardous Materials shall be issued for a period specified by the Administration, which shall not exceed five years.
3An International Ready for Recycling Certificate shall be issued for a period specified by the Administration that shall not exceed three months.
4An International Ready for Recycling Certificate issued under regulation 11 or 12 shall cease to be valid if the condition of the ship does not correspond substantially with the particulars of the certificate.
5The International Ready for Recycling Certificate may be extended by the Administration or by any person or organization authorized by it for a single point to point voyage to the Ship Recycling Facility.
CHAPTER 3 - REQUIREMENTS FOR SHIP RECYCLING FACILITIES
Regulation 15 - Controls on Ship Recycling Facilities
1Each Party shall establish legislation, regulations, and standards that are necessary to ensure that Ship Recycling Facilities are designed, constructed, and operated in a safe and environmentally sound manner in accordance with the regulations of this Convention.
2Each Party shall establish a mechanism for authorizing Ship Recycling Facilities with appropriate conditions to ensure that such Ship Recycling Facilities meet the requirements of this Convention.
3Each Party shall establish a mechanism for ensuring that Ship Recycling Facilities comply with the requirements of this chapter including the establishment and effective use of inspection, monitoring and enforcement provisions, including powers of entry and sampling. Such a mechanism may include an audit scheme to be carried out by the Competent Authority(ies) or an organization recognized by the Party, taking into account guidelines developed by the Organization, and the results of these audits should be communicated to the Organization.
4Each Party shall designate one or more Competent Authorities and the single contact point to be used by the Organization, Parties to this Convention and other interested entities, for matters related to Ship Recycling Facilities operating within the jurisdiction of that Party.
Regulation 16 - Authorization of Ship Recycling Facilities
1Ship Recycling Facilities which recycle ships to which this Convention applies, or ships treated similarly pursuant to Article 3.4, shall be authorized by a Party taking into account the guidelines developed by the Organization.
2The authorization shall be carried out by the Competent Authority(ies) and shall include verification of documentation required by this Convention and a site inspection. The Competent Authority(ies) may however entrust the authorization of Ship Recycling Facilities to organizations recognized by it.
3The Party shall notify the Organization of the specific responsibilities and conditions of the authority delegated to the recognized organizations, for circulation to Parties. In every case, the Competent Authority(ies) retains full responsibility for the authorization issued.
4The authorization shall be drawn up in the form set forth in Appendix 5. If the language used is neither English, French nor Spanish, the text shall include a translation into one of these languages.
5The authorization shall be valid for a period specified by the Party but not exceeding 5 years. The Party shall identify the terms for which the authorization will be issued, withdrawn, suspended, amended and renewed, and communicate these terms to the Ship Recycling Facilities. If a Ship Recycling Facility refuses inspection by the Competent Authority(ies) or the recognized organization operating on its/their behalf, the authorization shall be suspended or withdrawn.
6If incidents or actions taken at the Ship Recycling Facility have the effect that the conditions for the authorization are no longer fulfilled, the Ship Recycling Facility shall inform the Competent Authority(ies). The Competent Authority(ies) may accordingly decide to suspend or withdraw the authorization, or require corrective actions by the Ship Recycling Facility.
Regulation 17 - General requirements
1Ship Recycling Facilities authorized by a Party shall establish management systems, procedures and techniques which do not pose health risks to the workers concerned or to the population in the vicinity of the Ship Recycling Facility and which will prevent, reduce, minimize and to the extent practicable eliminate adverse effects on the environment caused by Ship Recycling, taking into account guidelines developed by the Organization.
2Ship Recycling Facilities authorized by a Party shall, for ships to which this Convention applies, or ships treated similarly pursuant to Article 3.4:
.1only accept ships that:
.1comply with this Convention; or
.2meet the requirements of this Convention;
.2only accept ships which they are authorized to recycle; and
.3have the documentation of its authorization available if such documentation is requested by a shipowner that is considering recycling a ship at that Ship Recycling Facility.
Regulation 18 - Ship Recycling Facility Plan
Ship Recycling Facilities authorized by a Party shall prepare a Ship Recycling Facility Plan. The Plan shall be adopted by the board or the appropriate governing body of the Recycling Company, and shall include:
.1a policy ensuring workers’ safety and the protection of human health and the environment, including the establishment of objectives that lead to the minimization and elimination to the extent practicable of the adverse effects on human health and the environment caused by Ship Recycling;
.2a system for ensuring implementation of the requirements set out in this Convention, the achievement of the goals set out in the policy of the Recycling Company, and the continuous improvement of the procedures and standards used in the Ship Recycling operations;
.3 identification of roles and responsibilities for employers and workers when conducting Ship Recycling operations;
.4a programme for providing appropriate information and training of workers for the safe and environmentally sound operation of the Ship Recycling Facility;
.5an emergency preparedness and response plan;
.6a system for monitoring the performance of Ship Recycling;
.7a record-keeping system showing how Ship Recycling is carried out;
.8a system for reporting discharges, emissions, incidents and accidents causing damage, or with the potential of causing damage, to workers’ safety, human health and the environment; and
.9 a system for reporting occupational diseases, accidents, injuries and other adverse effects on workers’ safety and human health,
taking into account guidelines developed by the Organization.
Regulation 19 - Prevention of adverse effects to human health and the environment
Ship Recycling Facilities authorized by a Party shall establish and utilize procedures to:
.1 prevent explosions, fires, and other unsafe conditions by ensuring that Safe-for-hot work conditions and procedures are established, maintained and monitored throughout Ship Recycling;
.2prevent harm from dangerous atmospheres and other unsafe conditions by ensuring that Safe-for-entry conditions and procedures are established, maintained, and monitored in ship spaces and enclosed spaces, throughout Ship Recycling;
.3prevent other accidents, occupational diseases and injuries or other adverse effects on human health and the environment; and
.4prevent spills or emissions throughout Ship Recycling which may cause harm to human health and/or the environment,
taking into account guidelines developed by the Organization.
Regulation 20 - Safe and environmentally sound management of Hazardous Materials
1Ship Recycling Facilities authorized by a Party shall ensure safe and environmentally sound removal of any Hazardous Material contained in a ship certified in accordance with regulations 11 or 12. The person(s) in charge of the recycling operations and the workers shall be familiar with the requirements of this Convention relevant to their tasks and, in particular, actively use the Inventory of Hazardous Materials and the Ship Recycling Plan, prior to and during the removal of Hazardous Materials.
2Ship Recycling Facilities authorized by a Party shall ensure that all Hazardous Materials detailed in the Inventory are identified, labelled, packaged and removed to the maximum extent possible prior to cutting by properly trained and equiped workers, taking into account the guidelines developed by the Organization, in particular:
.1hazardous liquids, residues and sediments;
.2substances or objects containing heavy metals such as lead, mercury, cadmium and hexavalent chromium;
.3paints and coatings that are highly flammable and/or lead to toxic releases;
.4asbestos and materials containing asbestos;
.5PCB and materials containing PCBs, ensuring that heat inducing equipment is avoided during such operations;
.6CFCs and halons; and
.7other Hazardous Materials not listed above and that are not a part of the ship structure.
3Ship Recycling Facilities authorized by a Party shall provide for and ensure safe and environmentally sound management of all Hazardous Materials and wastes removed from the ship recycled at that Ship Recycling Facility. Waste management and disposal sites shall be identified to provide for the further safe and environmentally sound management of materials.
4All wastes generated from the recycling activity shall be kept separate from recyclable materials and equipment, labelled, stored in appropriate conditions that do not pose a risk to the workers, human health or the environment and only transferred to a waste management facility authorized to deal with their treatment and disposal in a safe and environmentally sound manner.
Regulation 21 - Emergency preparedness and response
Ship Recycling Facilities authorized by a Party shall establish and maintain an emergency preparedness and response plan. The plan shall be made having regard to the location and environment of the Ship Recycling Facility, and shall take into account the size and nature of activities associated with each Ship Recycling operation. The plan shall furthermore:
.1 ensure that the necessary equipment and procedures to be followed in the case of an emergency are in place, and that drills are conducted on a regular basis;
.2 ensure that the necessary information, internal communication and co-ordination are provided to protect all people and the environment in the event of an emergency at the Ship Recycling Facility;
.3 provide for communication with, and information to, the relevant Competent Authority(ies), the neighbourhood and emergency response services;
.4 provide for first-aid and medical assistance, fire-fighting and evacuation of all people at the Ship Recycling Facility, pollution prevention; and
.5 provide for relevant information and training to all workers of the Ship Recycling Facility, at all levels and according to their competence, including regular exercises in emergency prevention, preparedness and response procedures.
Regulation 22 - Worker safety and training
1Ship Recycling Facilities authorized by a Party shall provide for worker safety by measures including:
.1ensuring the availability, maintenance and use of personal protective equipment and clothing needed for all Ship Recycling operations;
.2 ensuring that training programmes are provided to enable workers to safely undertake all Ship Recycling operations they are tasked to do; and
.3 ensuring that all workers at the Ship Recycling Facility have been provided with appropriate training and familiarization prior to performing any Ship Recycling operation.
2Ship Recycling Facilities authorized by a Party shall provide and ensure the use of personal protective equipment for operations requiring such use, including:
.1head protection;
.2face and eye protection;
.3hand and foot protection;
.4respiratory protective equipment;
.5hearing protection;
.6protectors against radioactive contamination;
.7protection from falls; and
.8appropriate clothing.
3Ship Recycling Facilities authorized by a Party may co-operate in providing for training of workers. Taking into account the guidelines developed by the Organization, the training programmes set forth in paragraph 1.2 of this regulation shall:
.1cover all workers including contractor personnel and employees in the Ship Recycling Facility;
.2be conducted by Competent persons;
.3provide for initial and refresher training at appropriate intervals;
.4include participants’ evaluation of their comprehension and retention of the training;
.5be reviewed periodically and modified as necessary; and
.6be documented.
Regulation 23 - Reporting on incidents, accidents, occupational diseases and chronic effects
1Ship Recycling Facilities authorized by a Party shall report to the Competent Authority(ies) any incident, accident, occupational diseases, or chronic effects causing, or with the potential of causing, risks to workers safety, human health and the environment.
2Reports shall contain a description of the incident, accident, occupational disease, or chronic effect, its cause, the response action taken and the consequences and corrective actions to be taken.
CHAPTER 4 - REPORTING REQUIREMENTS
Regulation 24 - Initial notification and reporting requirements
1A shipowner shall notify the Administration in due time and in writing of the intention to recycle a ship in order to enable the Administration to prepare for the survey and certification required by this Convention.
2A Ship Recycling Facility when preparing to receive a ship for recycling shall notify in due time and in writing its Competent Authority(ies) of the intent. The notification shall include at least the following ship details:
.1name of the State whose flag the ship is entitled to fly;
.2date on which the ship was registered with that State;
.3ship’s identification number (IMO number);
.4hull number on new-building delivery;
.5name and type of the ship;
.6port at which the ship is registered;
.7name and address of the Shipowner as well as the IMO registered owner identification number;
.8name and address of the company as well as the IMO company identification number;
.9name of all classification society(ies) with which the ship is classed;
.10ship’s main particulars (Length overall (LOA), Breadth (Moulded), Depth (Moulded), Lightweight, Gross and Net tonnage, and engine type and rating);
.11Inventory of Hazardous Materials; and
.12draft ship recycling plan for approval pursuant to regulation 9.
3When the ship destined to be recycled has acquired the International Ready for Recycling Certificate, the Ship Recycling Facility shall report to its Competent Authority(ies) the planned start of the Ship Recycling. The report shall be in accordance with the reporting format in Appendix 6, and shall at least include a copy of the International Ready for Recycling Certificate. Recycling of the ship shall not start prior to the submission of the report.
Regulation 25 - Reporting upon completion
When the partial or complete recycling of a ship is completed in accordance with the requirements of this Convention, a Statement of Completion shall be issued by the Ship Recycling Facility and reported to its Competent Authority(ies). This report must be compiled as shown in appendix 7. The Competent Authority(ies) shall send a copy of the Statement to the Administration which issued the International Ready for Recycling Certificate for the ship. The Statement shall be issued within 14 days of the date of partial or completed Ship Recycling in accordance with the Ship Recycling Plan and shall include a report on incidents and accidents damaging human health and/or the environment if any.

“Polychlorinated biphenyls” means aromatic compounds formed in such a manner that the hydrogen atoms on the biphenyl molecule (two benzene rings bonded together by a single carbon-carbon bond) may be replaced by up to ten chlorine atoms
For all ships, new installation of materials which contain Polychlorinated biphenyls shall be prohibited.

1. No ship may apply anti-fouling systems containing organotin compounds as a biocide or any other anti-fouling system whose application or use is prohibited by the AFS Convention
2. No new ships or new installations on ships shall apply or employ anti-fouling compounds or systems in a manner inconsistent with the AFS Convention.

1GENERAL TERMS
1.1Requirements of the Convention
The Ship Recycling Facility meets the requirements that it be designed, constructed, and operated in a safe and environmentally sound manner in accordance with the Convention, including meeting the relevant requirements of:

1.2 Acceptance of ships
For ships to which the Convention applies and ships treated similarly pursuant to Article 3.4 of the Convention, the Ship Recycling Facility can only accept a ship for recycling in accordance with regulation 17 of the Annex to the Convention.
1.3 Safe-for-hot-work and Safe-for-entry conditions
The Ship Recycling Facility is capable of establishing, maintaining and monitoring Safe-for-hot work and Safe-for-entry conditions throughout the Ship Recycling process.
